AMENDMENT TO HOUSE BILL 1305

AMENDMENT NO. ______. Amend House Bill 1305 by replacing everything after the enacting clause with the following:

"Section 5. The Consumer Fraud and Deceptive Business Practices Act is amended by adding Section 2QQQ as follows:

(815 ILCS 505/2QQQ new)

Sec. 2QQQ. Disclosure of changes in billing statements.

(a) A person who provides to a consumer a billing statement or other invoice for electric service, gas service, internet services, telecommunications service, or video services must disclose on the billing statement or invoice the reason for any change in the amount due from the most recently issued billing statement or invoice.

(b) The disclosure required under this Section must set forth:

(1) whether a promotional offer has expired;

(2) whether a tax has increased or decreased;

(3) whether a unit price rate has increased or decreased;

(4) any other reason for a change in the amount due.

(c) The disclosure required under this Section must appear in 2 separate locations on the billing statement or invoice. It must appear both at the top of the statement or invoice and near the amount due portion of the billing statement or invoice, be in bold print and in a color different from the rest of the billing statement or invoice, and be captioned as follows: "Changes In Your Bill". It must include at the first location a telephone number the consumer may use in contacting the person sending the billing statement or invoice for additional information.

(d) It is an unlawful practice within the meaning of this Act for a person to issue a billing statement or invoice that does not comply with the requirements of this Section.".
