Synopsis As Introduced
Amends the Illinois Vehicle Code. Prohibits a towing service from performing a removal of a commercial motor vehicle under that vehicle's own power without the authorization of a law enforcement officer. Effective July 1, 2015.

Adds the prohibition on "towing" a commercial motor vehicle by operating the vehicle under its own power as opposed to physically hauling the vehicle without the authorization of a law enforcement officer to the Section on unlawful practices by a commercial vehicle relocator.

Senate Floor Amendment No. 2
Provides that the limitation on removing a commercial motor vehicle by operating it under its own power only applies to commercial motor vehicles whose operation requires a commercial driver's license.

Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill. Further amends the Illinois Vehicle Code to provide that whenever a law enforcement officer issues a citation to a driver for operating an uninsured motor vehicle, the arresting officer shall authorize the removal and impoundment of the vehicle by a towing service if the driver has a prior conviction for driving without insurance in the past 12 months unless the vehicle the driver is operating is exempt from the insurance requirements of the Code. Provides that for vehicles that require a commercial driver's license to operate, a commercial vehicle relocator may charge a fee not greater than half its posted rate of towing service to disconnect a commercial vehicle if the owner or operator is present at the scene or arrives prior to removal. Provides that law enforcement agencies that patrol highways in this State shall establish tow rotation lists of towing services and requires officers of those agencies to utilize these tow rotation lists to select a towing service for officer initiated tows. Provides criteria for inclusion on a law enforcement agency's tow rotation list including licensing and insurance requirements. Provides that law enforcement agencies may require criminal background checks for owners and operators. Provides that final approval for inclusion on a particular tow rotation list lies with the head of the administering law enforcement agency. Provides that complaints with a tow rotation list may be referred in writing to the head of the law enforcement agency administering that tow rotation list. Provides that law enforcement agencies whose jurisdiction is limited to municipalities having a population of 1,000,000 or more may work with an independent governmental agency to establish and maintain a tow rotation list. Provides that a tower that stops at the scene of an accident or disabled vehicle for the purpose of soliciting the owner or operator to enter into a towing service transaction or without being summoned to the scene by a law enforcement officer shall be subject to a fine between $500 and $1000, and shall have his or her driver's license suspended for 3 months after which the driver's license shall not be reinstated until the payment of a $100 reinstatement fee. Provides that a person that violates this provision while his or her driver's license is already suspended for a previous violation shall have his or her driver's license suspended for 6 months, after which the driver's license shall not be reinstated until the payment of a $100 reinstatement fee. Provides that towers that misrepresent their affiliation with the State, a unit of local government, an insurance company, a private club, a law enforcement agency's tow rotation list, or any other entity shall be subject to license suspension and a monetary fine up to $1000.

House Floor Amendment No. 2

Replaces everything after the enacting clause. Reinserts the provisions of House Committee Amendment No. 1. Amends the insurance requirements for inclusion on a tow rotation list to require general liability insurance of $1,000,000, $100,000 minimum garage keepers legal liability insurance, and $100,000 minimum on-hook coverage or cargo insurance. Clarifies that a law enforcement agency may choose to have only one towing service on its tow rotation list. Replaces the provision that law enforcement agencies whose jurisdiction is limited to municipalities having a population of 1,000,000 or more may work with an independent governmental agency to establish and maintain a tow rotation list with a provision that law enforcement agencies whose jurisdiction is limited to municipalities having a population of 1,000,000 or more shall not be required to change any towing procedures or policies in effect on the effective date of this amendatory Act. Provides that the $100 reinstatement fee for a person whose driver's license was suspended for violating the prohibition on soliciting a tow at an accident or disablement scene shall be paid into the Road Fund.
