Statutes Amended In Order of Appearance
750 ILCS 5/609from Ch. 40, par. 609

Synopsis As Introduced
Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that notwithstanding any other provision of law, a party to a custody action who is residing in the United States under an H-4 or L-2 visa shall be allowed to permanently return to his or her country of origin with the minor child or children and commence child custody proceedings in his or her country of origin.

Senate Committee Amendment No. 1
Replaces the amendatory provisions with new language providing that if a party to a custody action is residing in the United States under a B-2, F-2, H-4, J-2, or L-2 visa and has been granted temporary or permanent custody of the child, there is a rebuttable presumption in favor of allowing immediate and permanent removal of the child to that party's country of origin unless the party opposing removal shows a present serious endangerment to the child if removal is allowed.

Senate Committee Amendment No. 2
Replaces everything after the enacting clause. Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that if raised as an issue by either party, the court shall consider a parent's current or future lack of legal immigration status as a factor when deciding the issue of permanent removal of a child or children from this State.
