Illinois General Assembly - Bill Status for SB 2583

Amends the Illinois Vehicle Code. Repeals the Section concerning license as bail. Provides that residents of this State and residents of any other state which is a member of the Nonresident Violator Compact of 1977 who are cited by a police officer for violating a traffic law or ordinance shall have the option of (1) being taken without unnecessary delay before a court of jurisdiction or (2) executing a written promise to comply with the terms of the citation by signing at least one copy of a Uniform Traffic Ticket prepared by the police officer. Provides that the Secretary of State shall suspend the driving privileges of a resident who fails to comply with the executed written promise to comply with the original terms of the citation until the Secretary receives notification by the court of jurisdiction that the person has appeared or otherwise executed the written promise to comply with the terms of the original citation. Amends the Code of Criminal Procedure of 1963. Removes a provision allowing the Supreme Court to include deposit of a chauffeur's or operator's license in the bail schedule for traffic cases. Makes corresponding changes in other portions of the Code.

Replaces everything after the enacting clause. Reinserts the provisions of the original bill. Repeals the Section concerning procedures for residents of other states. Creates a new Section governing the procedures for all traffic violations. Provides that for a traffic violation that is a petty offense as defined by the Unified Code of Corrections, no bond shall be required and personal recognizance shall be acceptable unless prohibited by law. Provides that the procedure for traffic violations that aren't petty offenses shall be governed by Supreme Court Rules. Provides that if a person fails to appear for a court date, the court shall continue the case for a minimum of 30 days and notify the person at their address of record with the Secretary of State. Provides that if, on the second court date, the person has not appeared, paid in full the amount necessary to satisfy the citation, or satisfied the court that their appearance, through no fault of their own, is impossible, the court shall order the person's license suspended. Provides that this suspension shall be entered by the Secretary of State as a Failure to Appear suspension, and that this suspension may not be lifted, nor any other permit issued to the person, until the satisfaction of the judgment against the person. Amends the Unified Code of Corrections. Provides that the Supreme Court may prescribe a uniform schedule of bail amounts in all but felony offenses. Provides that bail shall not be required for petty offenses.

Provides that the new Section stating bond is not required for petty offenses does not apply to business offenses or to violations of the wheel and axle load limits of the Illinois Vehicle Code. Provides that if a person fails to appear on his or her appointed court date, the court may continue the case to notify the person of his or her new court date, rather than requiring the court to continue the case. Removes the original bill's addition of a $50 minimum fine for petty offenses under the Illinois Vehicle Code. Removes the original bill's repeal of the Section governing traffic stop procedures and bail for residents of other states. Restores the provision that the bail schedule may require deposit of a chauffeur's or operator's license in addition to 10% of bail. Makes technical changes.
