Synopsis As Introduced
Amends the Criminal Code of 2012. Makes a technical change in a Section concerning the applicability of the common law.

Senate Floor Amendment No. 1
Deletes reference to:
720 ILCS 5/1-3
Adds reference to:
725 ILCS 5/115-5from Ch. 38, par. 115-5

Replaces everything after the enacting clause. Amends the Code of Criminal Procedure of 1963. Provides that upon request of the moving party and with reasonable notice given to the opposing party, in a criminal prosecution in which the defendant is accused of an offense under Article 16 or 17 of the Criminal Code of 1961 or the Criminal Code of 2012, the court may, for good cause and upon appropriate safeguards, permit foundational testimony business records as evidence in open court by means of a contemporaneous audio and video transmission from a different location.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Reinstates the provisions of the bill, but requires the foundational testimony business record to be live, subject to cross examination, and transmitted by audio or video transmission from outside of Illinois.
