Synopsis As Introduced
Amends the Environmental Protection Act. Provides that all powers, duties, rights, and responsibilities of the Department of Public Health under the Asbestos Abatement Act and the Commercial and Public Buildings Asbestos Abatement Act are transferred to the Illinois Environmental Protection Agency. Makes conforming changes to the Asbestos Abatement Act and the Commercial and Public Buildings Asbestos Abatement Act. Effective July 1, 2013.

Replaces everything after the enacting clause. Reinserts the provisions of the original bill with the following differences. Creates the Asbestos Occupations Licensure Act. Provides that persons licensed to perform asbestos abatement-related activities under the Asbestos Abatement Act or the Commercial and Public Building Asbestos Abatement Act shall be licensed by the Department of Public Health. Repeals Sections of the Asbestos Abatement Act and the Commercial and Public Building Asbestos Abatement Act recodified in the Asbestos Occupations Licensure Act. Amends additional Sections of the Environmental Protection Act. Provides that after the effective date of this Act, rulemaking for the Asbestos Abatement Act or the Commercial and Public Building Asbestos Abatement Act shall be done by the Pollution Control Board. Effective July 1, 2013.

House Floor Amendment No. 3
Replaces everything after the enacting clause. Amends the State Universities and Downstate Teacher Articles of the Illinois Pension Code. Provides that all actions brought by or against the boards of trustees of the respective systems shall be prosecuted or defended by the Attorney General (rather than the Attorney General or other counsel). Provides that if the boards of trustees of the respective systems pursue a mandamus action under the Code as amended by Senate Bill No. 1 of the 98th General Assembly in the form passed by the General Assembly, then the boards may select the counsel of their choice. Effective immediately.

 State Debt Impact Note, House Floor Amendment No. 2 (Government Forecasting & Accountability)
 This bill would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

 Correctional Note, House Floor Amendment No. 2 (Dept of Corrections)
 There are no penalty enhancements associated with SB 1961 (H-AM 2). The bill would have no fiscal or population impact on the Department of Corrections.

 Fiscal Note, House Floor Amendment No. 2 (Office of the Attorney General)
 SB 1961 (H-AM 2) would have minimal fiscal impact on the Office of the Attorney General and is likely to reduce legal costs for SURS and TRS.
