Replaces everything after the enacting clause. Amends the Hydraulic Fracturing Regulatory Act. Removes provisions authorizing the Illinois Department of Natural Resources to adopt rules under the Act. Adds provisions that a person may not conduct high volume horizontal hydraulic fracturing operations, drill, deepen, or convert a horizontal well in this State where high volume horizontal hydraulic fracturing operations are planned or occurring, or convert a vertical well into a horizontal well where high volume horizontal hydraulic fracturing operations are planned in this State, unless the person is registered with the Department, has been issued a permit by the Department, and has obtained all applicable authorizations required by the Illinois Oil and Gas Act. Establishes requirements for the registration and permit processes and the application criteria. Provides that, when a permit application is received by the Department, any person, government agency, or county board having an interest under a proposed permit may file a written request for public hearing and establishes procedural requirements for the hearing process. Further provides that the Department shall have no more than 60 calendar days after the date it receives the permit application to approve or reject the application for the high volume horizontal hydraulic fracturing permit. Establishes requirements for the construction and drilling of a well and reporting requirements that a permittee must meet. Removes references to the Department creating rules. Makes other changes. Effective immediately.

House Committee Amendment No. 2
Removes a provision concerning a Northern Illinois moratorium. Provides that notwithstanding any other provision of law, high volume horizontal fracturing operations shall only be allowed under this Act: (1) at well sites located in the counties of Alexander, Bond, Calhoun, Christian, Clark, Clay, Clinton, Coles, Crawford, Cumberland, Douglas, Edgar, Edwards, Effingham, Fayette, Franklin, Gallatin, Greene, Hamilton, Hardin Jackson, Jasper, Jefferson, Jersey, Johnson, Lawrence, Macoupin, Madison, Marion, Massac, Monroe, Montgomery, Moultrie, Perry, Pope, Pulaski, Randolph, Richland, Saline, Shelby, St. Clair, Union, Wabash, Washington, Wayne, White, or Williamson; and (2) on or after a period of one year after the effective date of this amendatory Act of the 98th General Assembly, in the counties of Adams, Boone, Brown, Bureau, Carroll, Cass, Champaign, DeWitt, Ford, Fulton, Hancock, Henderson, Henry, Iroquois, Jo Daviess, Knox, La Salle, Lee, Livingston, Logan, Macon, Marshall, Mason, McDonough, McLean, Menard, Mercer, Morgan, Ogle, Peoria, Piatt, Pike, Putnam, Rock Island, Sangamon, Schuyler, Scott, Stark, Stephenson, Tazewell, Vermilion, Warren, Whiteside, Winnebago, or Woodford.
