Synopsis As Introduced
Amends the Unemployment Insurance Act. Provides that the term "employment" does not include the delivery or distribution of newspapers or shopping news to the consumer, rather than to the ultimate consumer. Deletes provisions relating to delivery to the ultimate consumer. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Unemployment Insurance Act. Provides that provisions of the Act concerning services performed delivering newspapers or shopping news, and not provisions concerning independent contractors, control the determination of employment status for services performed by individuals in the delivery or distribution of shopping news. Sets forth factors to be considered in the determination of employment in connection with the delivery or distribution of newspapers or shopping news to the ultimate consumer, including whether the individual gains the profits and bears the losses of the business enterprise and whether the employing unit does not represent the individual as an employee of the firm to its customers. Provides that the factors are to be taken in the disjunctive, not in the conjunctive, and that not every factor must be satisfied in order to determine that an independent contractor relationship exists.

Replaces everything after the enacting clause. Amends the Minimum Wage Law. Increases the minimum wage from $8.25 to $9.00 beginning July 1, 2015 and increases it by $0.50 each July 1 until July 1, 2019, at which point the minimum wage will be $11.00. Provides that the establishment of a minimum wage that employers must pay their employees is an exclusive power and function of the State and is a denial and limitation of the home rule powers and functions, except that the limitation on home rule powers does not apply to a specified ordinance adopted by the City Council of City of Chicago. Amends the Illinois Income Tax Act. Creates a credit against the withholding tax liability of employers with fewer than 50 employees in an amount equal to the increased wages paid as a result of the increase in the minimum wage.
