Synopsis As Introduced
Amends the School Code and the Communicable Disease Prevention Act. Provides that, beginning July 1, 2014, upon entering the 7th and 12th grade of any public, private, or parochial school, a student shall present to the school proof of having received an immunization containing meningococcal conjugate vaccine. Requires the Department of Public Health to adopt a rule requiring students, upon entering the 7th and 12th grade of any public, private, or parochial school, to receive an immunization containing meningococcal conjugate vaccine beginning July 1, 2014.

House Committee Amendment No. 1
Requires a student to receive and present proof of having received the immunization upon entering the 6th (instead of 7th) grade.

House Committee Amendment No. 2
Provides that proof of having received an immunization containing meningococcal conjugate vaccine shall consist of documentation of one dose of the MCV4 vaccine for 6th grade entrance and documentation of 2 doses for 12th grade entrance, unless the first dose was administered to a child who was 16 years of age or older, in which case documentation of only one dose is required at 12th grade entrance. Makes a related change in the provisions amending the Communicable Disease Prevention Act.

Deletes reference to:

Deletes the amendatory changes to the School Code.

Senate Committee Amendment No. 4
Provides that if the Centers for Disease Control and Prevention Advisory Committee on Immunization Practices' recommendations for adolescents are updated, then the requirement under the provision concerning meningococcal conjugate vaccines should reflect those changes to be current. Deletes language providing that the immunization requirement shall apply beginning July 1, 2014 and that the requirement shall not apply if (i) the parent or guardian of the student objects thereto on the grounds that the administration of immunizing agents conflicts with the parent or guardian's religious tenets or practices or (ii) a physician employed by the parent or guardian to provide care and treatment to the student states that the physical condition of the student is such that the administration of the required immunizing agent would be detrimental to the health of the student. Provides instead that the immunization requirement shall not apply before 6 months after final rules are approved and that existing Illinois standards for parental or legal guardian objections or medical objections shall be applicable.

Senate Committee Amendment No. 5
Removes the provision that requires the Department of Public Health to adopt the rule requiring students to receive an immunization containing meningococcal conjugate vaccine notwithstanding provisions of the Communicable Disease Prevention Act concerning the rulemaking process with respect to rules requiring immunization.
