Synopsis As Introduced
Amends the Juvenile Court Act of 1987. Deletes provision that the State's Attorney may object in open court to an order of continuance under supervision.

Senate Floor Amendment No. 1
Replaces everything after the enacting clause. Amends the Juvenile Court Act of 1987. Provides on delinquency petitions other than first degree murder, a Class X felony, or a forcible felony, the minor, his or her parent, guardian, or legal custodian, the minor's attorney, or the State's Attorney can object to an order of continuance under supervision before a finding of delinquency is made (rather than before adjudication or hearing evidence) and if an objection is made the court may not order a continuance under supervision. After a finding of delinquency allows the court to order a continuance under supervision after considering the circumstances of the offense and the history, character, and condition of the minor, if the court is of the opinion that: (1) the minor is not likely to commit further crimes; (2) the minor and the public would be best served if the minor were not to receive a criminal record; and (3) in the best interests of justice an order of continuance under supervision is more appropriate than a sentence otherwise permitted under the Juvenile Court Act of 1987. If warranted by the conduct of the minor and the ends of justice, in addition to allowing the court to terminate a continuance under supervision, the court may also vacate the finding of delinquency or terminate supervision and vacate the finding of delinquency.
