Synopsis As Introduced
Amends the Criminal Identification Act. Provides that a petitioner may petition the circuit court to expunge the records of his or her arrests when he or she has been convicted of or placed on supervision for a misdemeanor that occurred more than 15 years before the filing of the petition if the person has not committed another offense within that period, other than minor traffic offenses. Provides that prior to the granting of the petition, the Director of State Police shall certify that the person has no other records of arrest and conviction within that time period, other than minor traffic offenses. Provides that the circuit court clerk shall charge a $150 fee per offense plus court costs for the expungement. Provides that the fees shall be deposited in the State treasury in a special fund known as the Misdemeanor Expungement Fund. Provides that the Secretary of Human Services shall disburse moneys in the fund as grants to certain specified organizations.

Replaces everything after the enacting clause. Amends the Criminal Identification Act. Deletes provision that the court shall not order the sealing of records for offenses defined as "crimes of violence" in the Crime Victims Compensation Act or a similar provision of a local ordinance. Provides that a petitioner may petition the circuit court to expunge the records of his or her arrest for a criminal offense that results in a conviction for anything other than a felony, except for certain excluded offenses, if a person has not been convicted of another criminal offense within a 7-year period for anything other than a minor traffic offense. Provides that the records are not eligible for expungement until 7 years have passed following the termination of the sentence with no further convictions during that time frame. Deletes the amendatory change to the State Finance Act.

Replaces everything after the enacting clause. Amends the Criminal Identification Act. Deletes provision that the court shall not order the sealing of records for offenses defined as "crimes of violence" in the Crime Victims Compensation Act or a similar provision of a local ordinance. Provides that a petitioner may petition the circuit court to expunge the records of his or her arrest and charges not initiated by arrest when he or she has been convicted of a criminal offense for anything other than: (1) a felony or (2) certain excluded offenses. Provides that the records are not eligible for expungement until 7 years after the termination of the petitioner's last sentence. Lists factors that the court must consider when an objection is made to the expungement or sealing of records.

Replaces everything after the enacting clause. Amends the Criminal Identification Act. Removes the prohibition on sealing of records of court supervision or qualified probation on certain misdemeanor offenses. Removes the prohibition on sealing the records of arrests or charges not initiated by arrest which result in a conviction for a misdemeanor crime of violence as defined in the Crime Victims Compensation Act, except for domestic battery, battery of an unborn child, Section 125 of the Stalking No Contact Order Act, or Section 219 of the Civil No Contact Order Act.
