Illinois General Assembly - Bill Status for HB 2332

Amends the Cannabis Control Act. Provides that a person who knowingly possesses not more than 0.1 gram of any substance containing cannabis is guilty of a petty offense and shall be fined $100 for a first offense, $200 for a second offense, and $300 for a third or subsequent offense. Provides that a person convicted of a third or subsequent offense shall perform 20 hours of community service at a drug-abuse treatment center licensed by the Department of Human Services. Changes the allocation of fines under the Act. Provides that, in addition to the allocation of fines to units of government that made the seizure of the cannabis, proceeds of fines collected under the Act shall also be used by the Department of Human Services for the funding of programs and services for drug-abuse treatment, prevention and education services for both juveniles and adults. Effective immediately.

Replaces everything after the enacting clause. Amends the Counties Code, the Illinois Municipal Code, and the Cannabis Control Act. Provides that notwithstanding provisions of the Cannabis Control Act to the contrary, a county or municipality may adopt an ordinance or resolution that declares possession of not more than 15 grams of cannabis a petty offense. Provides that the county or municipality may determine the amount of the fine to be imposed for possession of not more than 15 grams of cannabis. Provides that the county or municipality may adopt a uniform citation form to be issued by a sheriff or peace officer who arrests a person for possession of not more than 15 grams of cannabis. Provides that if the county or municipality adopts a uniform citation form, a sheriff or peace officer may instead of arresting the person for possession of cannabis issue a notice to appear as provided in the Code of Criminal Procedure of 1963. Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that neither a local public entity nor a public employee is liable, except for willful or wanton conduct, for failure to enforce provisions of the Cannabis Control Act concerning the possession of 15 grams or less of cannabis in a county or municipality that has adopted an ordinance or resolution that declares possession of not more than 15 grams of cannabis a petty offense.
