Synopsis As Introduced
Amends the Liquor Control Act of 1934. Provides that, if the local liquor control commissioner in a municipality with a population of 1,000,000 or more inhabitants has reason to believe, based upon the occurrence of criminal activity, that any continued operation of the premises poses an excessive risk to the health, safety, or welfare of the community, then the local liquor control commissioner may order, without notice or hearing, that a licensed premises be closed for up to 30 days, giving the licensee an opportunity to be heard during that period. Provides that if the sale of alcoholic liquor is incidental to the sale of food or other goods and services, then the order shall only apply to the sale of alcoholic liquor. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Reinserts the language of the introduced bill. Provides that if the licensee is also engaged in the conduct of another business or businesses on the licensed premises, the order to close the premises shall not be applicable to the other business or businesses (rather than if the sale of alcoholic liquor is incidental to the sale of food or other goods and services, then the order shall only apply to the sale of liquor). Effective immediately.

House Floor Amendment No. 2
Replaces everything after the enacting clause. Reinserts the bill as amended by House Amendment No. 1 with the following change. Provides that if the premises for which a license was issued are located within a city, village, or incorporated town having a population of 1,000,000 or more inhabitants and the local liquor control commissioner has evidence (instead of reason to believe), based upon the occurrence of criminal activity, that any continued operation of the licensed premises poses an excessive risk to the health, safety, or welfare of the community, then the local liquor control commissioner may take certain action.

Senate Floor Amendment No. 1
Specifies the types of criminal activity that trigger the closure provision. Deletes language allowing other business to be conducted on the licensed premises during the closure period. Provides that a distributor may, in coordination with the local liquor control commissioner and the local police department, remove any product for which the distributor has not received full payment from the licensee at the time of the closure of the premises. Requires the distributor to provide the local liquor control commissioner with a document outlining the products for which full payment has not been received.

Senate Floor Amendment No. 2
Provides that upon the local liquor commissioner's receipt of evidence of certain criminal activity occurring on licensed premises, the local liquor control commissioner may submit the name of the licensee and the address of the licensed premises where the criminal activity is alleged to have occurred to the Illinois Liquor Control Commission. Provides that if the Illinois Liquor Control Commission receives that information, then the Illinois Liquor Control Commission must post that information in each of its offices in places available for public inspection not later than the day following receipt of the information. Makes other changes.
