Synopsis As Introduced
Amends the Public Utilities Act, Pharmacy Practice Act, Public Aid Code, Illinois Marriage and Dissolution of Marriage Act, Non-Support Punishment Act, and Income Withholding for Support Act. Provides that notwithstanding any other provision, if a person is either an unemployed individual who is eligible for unemployment benefits under the Unemployment Insurance Act or an unemployed individual who is no longer eligible for extended benefits because the individual has exhausted his or her extended benefits under that Act, then (i) a public utility company that receives any federal or State funds shall not terminate or cut off the gas or electrical services, (ii) a pharmacy or pharmacist who receives any federal or State funds shall not refuse to dispense prescription medication, or (iii) the unemployed individual shall not be sentenced to any period of imprisonment for failure to make child support payments. Amends the Code of Civil Procedure. Provides that notwithstanding any other provision, no person may bring a forcible entry or detainer action for the possession of lands or leased premises against any person who is an unemployed individual who is eligible for unemployment benefits or who is no longer eligible for extended unemployment benefits. Provides that notwithstanding any other provision, no mortgagee who receives any federal or State funds may institute foreclosure proceedings against any mortgagor who is an unemployed individual who is eligible for unemployment benefits or who is no longer eligible for extended unemployment benefits. Defines "receives any federal or State funds". Effective immediately.

Replaces everything after the enacting clause. Amends the Public Utilities Act. Provides that if a customer contacts a public utility concerning the customer's difficulty in paying their utility bill, then the public utility shall offer to connect a qualifying low-income customer to the Low Income Energy Assistance Program managed by the Community and Economic Development Association. Provides that the public utility shall post information concerning the Low Income Energy Assistance Program on their websites and the information shall be made available upon a customer's request. Amends the Pharmacy Practice Act. Provides that a pharmacy or pharmacist shall not refuse to dispense prescription medication for 30 days to a person who is receiving unemployment benefits to allow the customer time to sign up for a program that is designed to help low-income, uninsured Illinois residents get free or discounted medications. Amends Code of Civil Procedure. Provides that a court that enters a judgment shall set aside a sale held upon motion of the mortgagor at any time prior to the confirmation of the sale, if the mortgagor proves by a preponderance of the evidence that (i) the mortgagor is receiving assistance under the Illinois Hardest Hit Program and (ii) the assistance received has enabled the mortgagor to reinstate the mortgage and make continuing mortgage payments as available under the Illinois Hardest Hit Program to avoid default. Provides that nothing shall prohibit the mortgagee from proceeding in the foreclosure action upon a subsequent default of the mortgagor. Provides that upon receiving notice of foreclosure, a person receiving unemployment benefits may apply to the court requesting that it enjoin the foreclosure. Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that if either parent fails to pay support due to unemployment, then the court may not fine or sentence the parent to periodic imprisonment. Effective immediately.

House Floor Amendment No. 4
Removes language that provides that upon receiving notice of foreclosure, a person receiving unemployment benefits may apply to the court requesting that it enjoin the foreclosure.

House Floor Amendment No. 5
Amends the Public Utilities Act. Replaces language concerning residential hardship programs. Provides that if a residential customer contacts a public utility concerning the customer's financial hardship and inability to pay utility bills for winter energy services, then the public utility shall refer the customer to the Low Income Home Energy Assistance Program managed by the Department of Commerce and Economic Opportunity (instead of the Community and Economic Development Association). Provides that when making a referral, the public utility shall inform the customer that the Low Income Home Energy Assistance Program is designed to assist income-eligible households with winter energy services through payment in the form of a grant for assistance made on behalf of the customer to the utilities(instead of a one-time benefit payment made to the public utilities).

House Floor Amendment No. 6
Amends the Pharmacy Practice Act. Removes language that provides that a pharmacy or pharmacist shall not refuse to dispense prescription medication for 30 days to a person who is receiving unemployment benefits to allow the customer time to sign up for a program that is designed to help low-income, uninsured Illinois residents get free or discounted medications. Provides that if a person is unemployed and requires prescription medication, then upon filing for benefits with the Department of Employment Security or upon applying for Medicaid benefits with the Department of Healthcare and Family Services, the respective Department shall inform the applicant of the benefits of acquiring prescription medications via materials developed by the agency and distributed through that respective agency. Provides that the services of referral agencies, such as Partnership for Prescription Assistance, can facilitate access to free or discounted medications per the needs of the patients.

Replaces everything after the enacting clause. Amends the Nursing Home Care Act and the Illinois Public Aid Code. In the Nursing Home Care Act, eliminates a provision that certain minimum staffing ratio requirements shall remain in effect until an acuity based registered nurse requirement is promulgated by rule concurrent with the adoption of the Resource Utilization Group (RUG) classification-based payment methodology, as provided in the Illinois Public Aid Code. Provides that both the 25% licensed nurse requirement and 10% registered nurse requirement shall remain in effect until an acuity based licensed nurse requirement and registered nurse requirement are adopted in administrative rules subsequent to the implementation of the RUG classification-based payment methodology. Provides that an acuity based licensed nurse requirement and registered nurse requirement shall not be made effective before January 1, 2014. In the Illinois Public Aid Code, provides that the methodologies for Medicaid reimbursement of nursing services shall no longer be applicable for bills payable for nursing services rendered on or after a new reimbursement system based on the Resource Utilization Groups (RUGs) has been fully operationalized, which shall take effect for services provided on or after July 1, 2013 (rather than on or after January 1, 2014). In provisions concerning Medicaid standards of payment to nursing facilities, provides that beginning July 1, 2013 (rather than January 1, 2014), the methodologies for reimbursement of nursing facility services shall no longer be applicable for services provided on or after July 1, 2013 (rather than on or after January 1, 2014). Effective immediately.

Replaces everything after the enacting clause. Amends the Illinois Horse Racing Act of 1975. Extends the authorization for advance deposit wagering to February 1, 2017. Provides that a race track located in Cook County may establish up to 8 inter-track wagering locations. Further provides that, beginning on February 1, 2014, a wagering licensee may impose additional surcharges on winning wagers and winnings from wagers. Provides for a hearing before the Illinois Racing Board on objections by nearby residents to proposed inter-track wagering locations within the City of Chicago. Preempts home rule. Makes other changes. Effective immediately.
