2 | WHEREAS, Current contracts to administer Health | ||||||
3 | Maintenance Organization (HMO) and Open Access Plan (OAP) | ||||||
4 | benefits for the State Employees' Group Insurance Program are | ||||||
5 | set to expire on June 30, 2011, and the Department of | ||||||
6 | Healthcare and Family Services initiated a | ||||||
7 | request-for-proposals process to select vendors to administer | ||||||
8 | those benefit programs after the expiration of the current | ||||||
9 | contracts; and
| ||||||
10 | WHEREAS, Pursuant to this process, the Illinois Department | ||||||
11 | of Healthcare and Family Services posted notice of intent to | ||||||
12 | award contracts to 4 managed care organizations in order to | ||||||
13 | provide HMO and OAP benefits to State employees, dependents, | ||||||
14 | and retirees starting on July 1, 2011; and
| ||||||
15 | WHEREAS, This notice is the subject of official protests | ||||||
16 | questioning the procurement process used to select the | ||||||
17 | potential vendors used to administer these health benefit | ||||||
18 | programs; and
| ||||||
19 | WHEREAS, The Illinois Procurement Code and administrative | ||||||
20 | regulations provide a broad grant of authority to the State to | ||||||
21 | cancel a solicitation (before or after the opening of bids) if | ||||||
22 | it would be in the State's best interests to do so, and that |

1 | authority may be exercised even though protests are under | ||||||
2 | review; and
| ||||||
3 | WHEREAS, Fundamental issues regarding access to, and the | ||||||
4 | cost of, adequate health care appear to be inextricably | ||||||
5 | intertwined with administrative and technical questions | ||||||
6 | pertaining to procedural compliance with the Illinois | ||||||
7 | Procurement Code and administrative rules; therefore, be it

8 | RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL | ||||||
9 | ASSEMBLY OF THE STATE OF ILLINOIS, that we find that the | ||||||
10 | circumstances surrounding these current procurements and their | ||||||
11 | potential to cause adverse effects on the State and its | ||||||
12 | citizens warrant a finding that it is in the best interests of | ||||||
13 | the State to cancel the existing solicitations; and be it | ||||||
14 | further

15 | RESOLVED, That we urge the Governor and the Chief | ||||||
16 | Procurement Officer to cancel those solicitations and to issue | ||||||
17 | a new request for proposals in a timely manner in order to | ||||||
18 | select an adequate network of administrators to provide access | ||||||
19 | to health care for all State employees, retirees, and | ||||||
20 | dependents; and be it further

21 | RESOLVED, That a suitable copy of this resolution be | ||||||
22 | presented to the Governor of the State of Illinois, the |

2 | Procurement Officer responsible for overseeing the HMO and OAP | ||||||
3 | procurement.
