2 | | BE IT RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL |
3 | | ASSEMBLY OF THE STATE OF ILLINOIS, that the Rules of the Senate |
4 | | of the 97th General Assembly are amended by changing Rule 10-2 |
5 | | as follows: |
6 | | (Senate Rule 10-2) |
7 | | 10-2. Appointment Messages. |
8 | | (a) Every nomination subject to the advice and consent of |
9 | | the Senate
shall be submitted to the Senate by an Appointment |
10 | | Message from
the appointing officer or appointing authority in |
11 | | accordance
with this Rule, using the Appointment Message form |
12 | | provided
in this Rule, containing all of the required |
13 | | information, and
accompanied by a cover letter signed by the |
14 | | appointing officer
or on behalf of the appointing authority. |
15 | | (b) All Appointment Messages shall be drafted by the
|
16 | | Legislative Reference Bureau, according to the form provided
in |
17 | | this Rule. |
18 | | (c) Appointment Messages submitted shall be assigned a
|
19 | | sequential number by the Secretary of the Senate, indicating
|
20 | | the order in which they were received and read into the Senate
|
21 | | record by the Secretary of the Senate at the direction of the
|

1 | | Senate President. An Appointment Message is received by the
|
2 | | Senate when it is read into the Senate record and assigned a
|
3 | | sequential number. |
4 | | (d) An Appointment Message that does not conform to the
|
5 | | requirements of this Rule shall, at the direction of the Senate
|
6 | | President, (i) be ruled non-compliant and of no legal effect |
7 | | and (ii) returned by the Secretary of the Senate to the
|
8 | | appointing officer or authority that filed it. |
9 | | (e) The appointing officer or authority may file in
|
10 | | accordance with this Rule an Appointment Message that
|
11 | | supersedes a previously filed Appointment Message. A
|
12 | | superseding Appointment Message shall identify by sequential |
13 | | number the
Appointment Message that it supersedes. The filing |
14 | | of a
superseding Appointment Message shall automatically table |
15 | | the
Appointment Message that it supersedes, and that superseded |
16 | | Appointment Message shall
have no further legal effect. |
17 | | (f) Nothing in this Rule shall be construed to prohibit an |
18 | | appointing officer or authority from withdrawing in writing an |
19 | | Appointment Message that was previously submitted to or |
20 | | received by the Senate. An Appointment Message that has been |
21 | | withdrawn shall have no further legal effect. |
22 | | (g) An Appointment Message (i) shall be a |

1 | | committee-sponsored
legislative measure that is unamendable |
2 | | and (ii) shall be
controlled by the Chairperson of the |
3 | | Executive Appointments
Committee, who for purposes of these |
4 | | Senate Rules shall be
deemed the principal sponsor. In the |
5 | | absence of the
Chairperson, the Vice-Chairperson of the |
6 | | Executive
Appointments Committee shall be deemed the principal |
7 | | sponsor.
Messages may not have individual cosponsors. |
8 | | (h) Any Appointment Message pending when the Senate
|
9 | | adjourns sine die (i) shall carry over into the next General |
10 | | Assembly and (ii) shall be considered to have been received by |
11 | | the Senate when originally read into the Senate record as |
12 | | provided for in subsection (c) of this Rule. An Appointment |
13 | | Message carrying over into the next General Assembly shall |
14 | | retain the sequential number assigned when originally read into |
15 | | the Senate record as provided for in subsection (c) of this |
16 | | Rule. |
17 | | (i) Notwithstanding the requirements contained in this |
18 | | Rule, any Appointment Message submitted to the 96th General |
19 | | Assembly and not acted upon by the 96th General Assembly is |
20 | | deemed to be carried over to the 97th General Assembly. The |
21 | | Senate may take action on any Appointment Message carried over |
22 | | from the Senate of the 96th General Assembly. Nothing in this |
23 | | Rule shall be construed to prohibit an appointing officer or |
24 | | authority from withdrawing in writing an Appointment Message |

1 | | that was previously submitted to or received by the Senate of |
2 | | the 96th General Assembly and carried over into the Senate of |
3 | | the 97th General Assembly. An Appointment Message carried over |
4 | | from the Senate of the 96th General Assembly that has been |
5 | | withdrawn in the Senate of the 97th General Assembly shall have |
6 | | no further legal effect. |

15 | | President, be ruled non-compliant and returned to the |
16 | | appointing officer or authority that filed the same by the |
17 | | Secretary of the Senate. |
18 | | (e) The appointing officer or authority may file in |
19 | | accordance with this rule an Appointment Message which |
20 | | supersedes a previously filed Appointment Message. A |
21 | | superseding Appointment Message shall identify by number the |
22 | | Appointment Message which it supersedes. The filing of a |

1 | | superseding Appointment Message shall automatically table the |
2 | | Appointment Message which it supersedes, and that message shall |
3 | | have no further legal effect. |
4 | | (f) An Appointment Message shall be a committee-sponsored |
5 | | legislative measure which is unamendable, and shall be |
6 | | controlled by the Chairperson of the Executive Appointments |
7 | | Committee, who for purposes of these Senate Rules shall be |
8 | | deemed the principal sponsor or, in the absence of the |
9 | | Chairperson, the Vice-Chairperson of the Executive |
10 | | Appointments Committee shall be deemed the principal sponsor. |
11 | | Messages may not have individual cosponsors. |
12 | | (g) Any Appointment Message pending when the Senate |
13 | | adjourns sine die shall automatically be tabled, and that |
14 | | message shall have no further legal effect. An appointing |
15 | | officer or authority shall file a new Appointment message in |
16 | | accordance with the Senate Rules of the new General Assembly if |
17 | | they wish for the nomination to be considered by the Senate for |
18 | | confirmation. |
