SYNOPSIS AS INTRODUCED:
 
ILCON Art. VII, Sec. 2

    Proposes to amend the Local Government Article of the Illinois Constitution. Provides that a single township or two or more contiguous townships may be disconnected from Cook County and may form a new county. Provides that the disconnection must be approved by referendum adopted by a majority of the votes cast on the proposition in the township or townships, as applicable. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3    RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Article VII of the
9Illinois Constitution by changing Section 2 as follows:

LOCAL GOVERNMENT

12    (ILCON Art. VII, Sec. 2)
13SECTION 2. COUNTY TERRITORY, BOUNDARIES AND SEATS
14    (a) The General Assembly shall provide by law for the
15formation, consolidation, merger, division, and dissolution of
16counties, and for the transfer of territory between counties.
17    (b) County boundaries shall not be changed unless approved
18by referendum in each county affected, except as provided in
19subsection (d).
20    (c) County seats shall not be changed unless approved by
21three-fifths of those voting on the question in a county-wide
22referendum.
23    (d) In Cook County, a single township or two or more

1contiguous townships may be disconnected from Cook County and
2form a new county. The disconnection must be approved by
3referendum adopted by a majority of the votes cast on the
4proposition in the township or townships, as applicable. The
5referendum may be initiated by ordinance of the township or
6townships, as applicable, or by petition signed by at least ten
7percent of the electors of the township or townships, as
8applicable, and the referendum shall be conducted, all as
9provided by law.

SCHEDULE
12    This Constitutional Amendment takes effect upon being
13declared adopted in accordance with Section 7 of the Illinois
14Constitutional Amendment Act.
