SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/5-301  from Ch. 121, par. 5-301

    Amends the Illinois Highway Code. Provides that before the Superintendent of Highways of a county with a population of 2 million or more inhabitants may update the long-range highway transportation plan for that county, as annually required, all of the following requirements must be met: (i) at least 90 days before the plan is required to be updated, the President of the Board of Commissioners of the county must submit the proposed updated plan to the Chairpersons of the Transportation Committees in the Senate and the House of Representatives, (ii) at least 90 days before the plan is required to be updated, the President of the Board of Commissioners of the county must prepare and deliver a presentation on the proposed updated plan for the Transportation Committees in each chamber and address any questions that members of those committees might have about the proposed updated plan, and (iii) at least 60 days before the plan is required to be updated, the proposed updated plan must be approved in whole or rejected in whole by joint resolution of the General Assembly. Provides that if these requirements are not met, then no State moneys may be spent or appropriated on highway improvement projects identified in the proposed updated plan. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by changing
5Section 5-301 as follows:
 
6    (605 ILCS 5/5-301)  (from Ch. 121, par. 5-301)
7    Sec. 5-301. Highway transportation plan.
8    (a) In order to properly plan the utilization of motor fuel
9tax funds each County Engineer or Superintendent of Highways,
10except for those in a county with a population of 185,000 or
11less, shall be required to develop and update a 20 year
12long-range highway transportation plan. The plan shall contain
13an estimate of revenues which will become available during that
14period and a statement of intention with respect to the
15construction, maintenance, and other related work to be done
16insofar as it is possible to make such estimates. In addition,
17the long-range plan shall show the location of existing county
18highways and the general corridors of future highways, the
19projected future traffic usage on each highway for a 20 year
20period, a tabulation showing the design standards and the
21geometric features associated with different levels of traffic
22usage, and a listing of the major improvements anticipated
23within 5 years of the date of each plan. A copy of the plan

1shall be filed with the Secretary of the Department of
2Transportation. A copy of the plan as it relates to each city
3over 5,000 population in the county shall be filed with the
4clerk of each municipality. The initial plan shall be on file
5with designated agencies by July 1, 1971, and shall be updated
6on an annual basis thereafter.
7    (b) Before the Superintendent of Highways of a county with
8a population of 2 million or more inhabitants may update the
9long-range highway transportation plan for that county, as
10annually required under subsection (a) of this Section, all of
11the following requirements must be met:
12        (1) At least 90 days before the plan is required to be
13    updated under subsection (a) of this Section, the President
14    of the Board of Commissioners of the county must submit the
15    proposed updated plan to the Chairpersons of the
16    Transportation Committees in the Senate and the House of
17    Representatives.
18        (2) At least 90 days before the plan is required to be
19    updated under subsection (a) of this Section, the President
20    of the Board of Commissioners of the county must prepare
21    and deliver a presentation on the proposed updated plan for
22    the Transportation Committees in each chamber and address
23    any questions that members of the committees might have
24    about the proposed updated plan.
25        (3) At least 60 days before the plan is required to be
26    updated under subsection (a) of this Section, the proposed

1    updated plan must be approved in whole or rejected in whole
2    by joint resolution of the General Assembly.
3    (c) If the requirements of subsection (b) are not
4satisfied, then no State moneys may be spent or appropriated on
5highway improvement projects identified in the proposed
6updated plan.
