2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:

4 | | Section 5. The Criminal Code of 1961 is amended by changing |
5 | | Section 18-3 as follows:

6 | | (720 ILCS 5/18-3)

7 | | Sec. 18-3. Vehicular hijacking.
|
8 | | (a) A person commits vehicular hijacking when he or she |
9 | | takes a motor
vehicle from the
the person or the immediate |
10 | | presence of another by the use of
force or by threatening the |
11 | | imminent use of force. |
12 | | (b) For the purposes of this Article, the term "motor |
13 | | vehicle" shall have
the meaning ascribed to it in the Illinois |
14 | | Vehicle Code.

15 | | (c) Sentence. Vehicular hijacking is a Class 1 felony.
