Amends the Counties Code. Authorizes the county board or board of county commissioners of a county to prohibit the use of coal tar pavement product on all roadways, driveways, and parking lots within the county. Defines "coal tar" and "coal tar pavement product".

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Counties Code is amended by adding Section |
5 | | 5-1134 as follows: |

7 | | Sec. 5-1134. Use of coal tar. The county board or board of |
8 | | county commissioners of a county may prohibit the use of coal |
9 | | tar pavement products on all roadways, driveways, and parking |
10 | | lots within the county. For the purposes of this Section, "coal |
11 | | tar" means a viscous substance obtained by the combustion of |
12 | | coal and containing levels of polycyclic aromatic hydrocarbons |
13 | | in excess of 10,000 milligrams per kilogram. "Coal tar" |
14 | | includes, but is not limited to, refined coal tar, high |
15 | | temperature coal tar, or coal tar pitch. "Coal tar" does not |
16 | | include any substance listed under Sections 3.135 or 3.140 of |
17 | | the Environmental Protection Act. "Coal tar pavement product" |
18 | | means a material that contains coal tar that is intended for |
19 | | use as a pavement sealant.
