SYNOPSIS AS INTRODUCED:

    Amends the School Code and the Illinois Vehicle Code. Provides that a multi-function school activity bus (MFSAB) may be used to transport students for any curriculum-related activity except for transportation on regular bus routes from home to school or from school to home. Provides that a MFSAB authorized to transport students under the new provisions must be operated by a holder of a school bus driver permit and is subject to certain provisions concerning contractual student transfer arrangements, contracts requiring school bus driver permits, liability insurance, and safety testing. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5.. The School Code is amended by changing Section
529-6.3 as follows:
 
6    (105 ILCS 5/29-6.3)
7    Sec. 29-6.3. Transportation to and from specified
8interscholastic or school-sponsored activities.
9        (a) Any school district transporting students in grade
1012 or below for an interscholastic, interscholastic athletic,
11or school-sponsored, noncurriculum-related activity that (i)
12does not require student participation as part of the
13educational services of the district and (ii) is not associated
14with the students' regular class-for-credit schedule or
15required 5 clock hours of instruction shall transport the
16students only in a school bus, a vehicle manufactured to
17transport not more than 10 persons, including the driver, or a
18multifunction school-activity bus manufactured to transport
19not more than 15 persons, including the driver.
20    (a-5) A student may be transported in a multi-function
21school activity bus (MFSAB) as defined in Section 1-148.3a-5 of
22this Code for any curriculum-related activity except for
23transportation on regular bus routes from home to school or

1from school to home, subject to the following conditions:
2        (i) A MFSAB may not be used to transport students under
3    this Section unless the driver holds a valid school bus
4    driver permit.
5        (ii) The use of a MFSAB under this Section is subject
6    to the requirements of Sections 6-106.11, 6-106.12,
7    12-707.01, 13-101, and 13-109 of this Code.
8    (b) Any school district furnishing transportation for
9students under the authority of this Section shall insure
10against any loss or liability of the district resulting from
11the maintenance, operation, or use of the vehicle.
12    (c) Vehicles used to transport students under this Section
13may claim a depreciation allowance of 20% over 5 years as
14provided in Section 29-5 of this Code.

16    Section 10. The Illinois Vehicle Code is amended by
17changing Section 11-1414.1 as follows:

19    Sec. 11-1414.1. School transportation of students.
20    (a) Every student enrolled in grade 12 or below in any
21entity listed in subsection (a) of Section 1-182 of this Code
22must be transported in a school bus or a vehicle described in
23subdivision (1) or (2) of subsection (b) of Section 1-182 of
24this Code for any curriculum-related school activity, except a

1student may be transported in a multi-function school activity
2bus (MFSAB) as defined in Section 1-148.3a-5 of this Code for
3any curriculum-related activity except for transportation on
4regular bus routes from home to school or from school to home,
5subject to the following conditions:
6        (i) A MFSAB may not be used to transport students under
7    this Section unless the driver holds a valid school bus
8    driver permit.
9        (ii) The use of a MFSAB under this Section is subject
10    to the requirements of Sections 6-106.11, 6-106.12,
11    12-707.01, 13-101, and 13-109 of this Code.
12    "Curriculum-related school activity" as used in this
13subsection (a) includes transportation from home to school or
14from school to home, tripper or shuttle service between school
15attendance centers, transportation to a vocational or career
16center or other trade-skill development site or a regional safe
17school or other school-sponsored alternative learning program,
18or a trip that is directly related to the regular curriculum of
19a student for which he or she earns credit.
20    (b) Every student enrolled in grade 12 or below in any
21entity listed in subsection (a) of Section 1-182 of this Code
22who is transported in a vehicle that is being operated by or
23for a public or private primary or secondary school, including
24any primary or secondary school operated by a religious
25institution, for an interscholastic, interscholastic-athletic,
26or school-sponsored, noncurriculum-related activity that (i)

1does not require student participation as part of the
2educational services of the entity and (ii) is not associated
3with the students' regular class-for-credit schedule shall
4transport students only in a school bus or vehicle described in
5subsection (b) of Section 1-182 of this Code. This subsection
6(b) does not apply to any second division vehicle used by an
7entity listed in subsection (a) of Section 1-182 of this Code
8for a parade, homecoming, or a similar noncurriculum-related
9school activity.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
