1 | | AN ACT concerning transportation.
|
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Highway Code is amended by changing |
5 | | Section 6-104 as follows:
|
6 | | (605 ILCS 5/6-104) (from Ch. 121, par. 6-104)
|
7 | | Sec. 6-104.
Whenever the territory of any municipality of a |
8 | | population of
not less than 15,000 is a part of a road district |
9 | | two or more road districts in a county
not under township |
10 | | organization, and shall by resolution of its council or
its |
11 | | president and board of trustees request the county board to |
12 | | organize it
into a separate road district and designate the |
13 | | name thereof, the county
board shall comply with such request, |
14 | | and provide for such organization of
such municipality into a |
15 | | new road district under the name designated in
such resolution |
16 | | of such city council, or president and board of trustees,
if |
17 | | any be designated therein.

18 | | Whenever a road district shall have been or shall hereafter |
19 | | be organized
as provided in this Section and any of the |
20 | | territory of such municipality
shall be disconnected from such |
21 | | municipality, the county board, upon
receipt of a certified |
22 | | copy of the resolution or ordinance of the
municipality |
23 | | disconnecting such territory, by resolution, shall disconnect

1 | | such territory from such road district and annex it to an |
2 | | adjacent road
district or districts. Whenever such |
3 | | municipality, at any one time shall
have annexed or shall |
4 | | hereafter annex any territory, the county board, by
resolution, |
5 | | shall disconnect such territory from the road district or
|
6 | | districts in which it may be situated and annex the same to the |
7 | | road
district in which such municipality is situated.
|
8 | | All the powers vested in a road district organized out of |
9 | | the territory
embraced within any municipality, including all |
10 | | the powers vested by law in
the highway commissioner of a road |
11 | | district, shall be vested in and
exercised by the city council, |
12 | | or president and board of trustees of such
municipality, |
13 | | including the power to levy a tax for the proper
construction, |
14 | | maintenance and repair of roads in such district as provided
in |
15 | | Section 6--501 of this Code. Any such tax whether heretofore or
|
16 | | hereafter levied shall be in addition to all other taxes levied |
17 | | in such
municipality and in addition to the taxes for general |
18 | | purposes authorized
in Section 8-3-1 of the Illinois Municipal |
19 | | Code, as heretofore and
hereafter amended.

20 | | All of the powers vested by law in the district clerk of a |
21 | | road district
shall be vested in and exercised by the city, |
22 | | town or village clerk of such
municipality.
|
23 | | After a road district has been organized out of the |
24 | | territory embraced
within a municipality, the offices and |
25 | | election of highway commissioner and
district clerk shall be |
26 | | discontinued.
