1    AN ACT concerning criminal law, which may be referred to as
2Caylee's law.
 
3    Be it enacted by the People of the State of Illinois,
4represented in the General Assembly:
 
5    Section 5. The Criminal Code of 1961 is amended by adding
6Section 12-21.6-1 as follows:
 
7    (720 ILCS 5/12-21.6-1 new)
8    Sec. 12-21.6-1. Failure to report disappearance of a
9child; failure to report death of a child.
10    (a) A parent, legal guardian, or other person having
11physical custody or control of a child, who is 13 years of age
12or younger, commits failure to report the disappearance of a
13child when he or she fails to notify the appropriate law
14enforcement agency in a timely manner, no later than 24 hours,
15of the child's disappearance; and
16        (1) knows that the child is missing; or
17        (2) reasonably should know that the child is missing.
18    (a-5) Sentence. Failure to report the disappearance of a
19child is a Class 4 felony.
20    (b) A parent, legal guardian, or other person having
21physical custody or control of a child, 17 years of age or
22younger, commits failure to report the death of a child when he
23or she discovers the death of a child and knows or reasonably

1should know that the death of the child occurred under the
2following circumstances and fails to notify the appropriate law
3enforcement agency, in the jurisdiction where the death
4occurred or where the death was discovered, in a timely manner,
5no later than 12 hours, of that discovery:
6        (1) a sudden or violent death, whether apparently
7    suicidal, homicidal, or accidental; or
8        (2) a death where the decedent was not attended by a
9    licensed physician.
10    (b-5) Sentence. Failure to report the death of a child is a
11Class 4 felony.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
