SYNOPSIS AS INTRODUCED:
 
730 ILCS 5/3-14-1.5

    Amends the Unified Code of Corrections. Provides that a parole agent or parole supervisor must receive training in the use of firearms initially at the Illinois Department of Corrections Parole Academy and be certified as having successfully completing the training by the Illinois Law Enforcement Training Standards Board upon graduation of parole training at the Academy. Thereafter, the parole agent or supervisor must successfully complete firearms training required for his or her position with the Department of Corrections. Eliminates provision that the training shall be taken while off-duty. Eliminates requirement that the agent or supervisor must register the firearm with the Department of State Police and with any other local law enforcement agency that requires registration. Effective immediately.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Unified Code of Corrections is amended by
5changing Section 3-14-1.5 as follows:
 
6    (730 ILCS 5/3-14-1.5)
7    Sec. 3-14-1.5. Parole agents and parole supervisors;
8off-duty firearms. Subsections 24-1(a)(4) and 24-1(a)(10) and
9Section 24-1.6 of the Criminal Code of 1961 do not apply to
10parole agents and parole supervisors who meet the following
11conditions:
12    (1) The parole agent or parole supervisor must receive
13training in the use of firearms while off-duty conducted by the
14Illinois Law Enforcement Training Standards Board initially at
15the Illinois Department of Corrections Parole Academy and be
16certified as having successfully completing such training by
17the Board upon graduation of parole training at the Academy.
18Thereafter, the parole agent or supervisor must successfully
19complete the firearms training required for his or her position
20with the Department of Corrections. The Board shall determine
21the amount of such training and the course content for such
22training. The parole agent or parole supervisor shall requalify
23for the firearms training annually at a State range certified

1by the Illinois Law Enforcement Training Standards Board. The
2expenses of such retraining shall be paid by the parole agent
3or parole supervisor and moneys for such requalification shall
4be expended at the request of the Illinois Law Enforcement
5Training Standards Board.
6    (2) The parole agent or parole supervisor shall purchase
7such firearm at his or her own expense and shall register the
8firearm with the Illinois Department of State Police and with
9any other local law enforcement agencies that require such
10registration.
11    (3) The parole agent or parole supervisor may not carry any
12Illinois Department of Corrections State issued firearm while
13off-duty. A person who violates this paragraph (3) is subject
14to disciplinary action by the Illinois Department of
15Corrections.
16    (4) Parole agents and supervisors who are terminated
17discharged from employment of the Illinois Department of
18Corrections shall no longer be considered law enforcement
19officials and all their rights as law enforcement officials
20shall be revoked permanently.
21    (5) Definition. For the purposes of this Section,
22"terminated" means terminated from employment due to internal
23disciplinary matters and not due to retirement from the agency
24or department they represent. State parole agents and
25supervisors shall retain the right to exercise the ability of
26off-duty status after mandated retirement if agents and

1supervisors seek eligibility with the Retired Officer's Carry
2Conceal Program which is supervised by the Illinois Law
3Enforcement Training Standards Board.
