SYNOPSIS AS INTRODUCED:
 
5 ILCS 430/5-20

    Amends the State Officials and Employees Ethics Act. Applies the prohibitions against the inclusion of names, images, and voices in public service announcements and the printing of names and images on promotional materials to State employees who are candidates for public office (now, the prohibitions apply only to executive branch constitutional officers and General Assembly members).

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Officials and Employees Ethics Act is
5amended by changing Section 5-20 as follows:
 
6    (5 ILCS 430/5-20)
7    Sec. 5-20. Public service announcements; other promotional
8material.
9    (a) Beginning January 1, 2004, no public service
10announcement or advertisement that is on behalf of any State
11administered program and contains the proper name, image, or
12voice of any executive branch constitutional officer, or member
13of the General Assembly, or, beginning on the effective date of
14this amendatory Act of the 97th General Assembly, State
15employee (if the State employee is a candidate for public
16office) shall be broadcast or aired on radio or television or
17printed in a commercial newspaper or a commercial magazine at
18any time.
19    (b) The proper name or image of any executive branch
20constitutional officer, or member of the General Assembly, or
21State employee (if the State employee is a candidate for public
22office) may not appear on any (i) bumper stickers, (ii)
23commercial billboards, (iii) lapel pins or buttons, (iv)

1magnets, (v) stickers, and (vi) other similar promotional
2items, that are not in furtherance of the person's official
3State duties or governmental and public service functions, if
4designed, paid for, prepared, or distributed using public
5dollars. This subsection does not apply to stocks of items
6existing (i) with respect to executive branch constitutional
7officers and General Assembly members, on the effective date of
8this amendatory Act of the 93rd General Assembly and (ii) with
9respect to State employees who are candidates for public
10office, on the effective date of this amendatory Act of the
1197th General Assembly.
12    (c) This Section does not apply to communications funded
13through expenditures required to be reported under Article 9 of
14the Election Code.
15    (d) For the purposes of this Section only:
16        (1) "Candidate" means a person who has filed nominating
17    papers or petitions for nomination or election to an
18    elective public office, or who has been appointed to fill a
19    vacancy in nomination, and who remains eligible for
20    placement on a primary or election ballot.
21        (2) "Public office" means any elective office for which
22    candidates are required by the Illinois Governmental
23    Ethics Act to file statements of economic interests.
