1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5changing Sections 7 and 8 as follows:

7    Sec. 7. The Board of Trustees of the University of
8Illinois, the Board of Trustees of Southern Illinois
9University, the Board of Trustees of Chicago State University,
10the Board of Trustees of Eastern Illinois University, the Board
11of Trustees of Governors State University, the Board of
12Trustees of Illinois State University, the Board of Trustees of
13Northeastern Illinois University, the Board of Trustees of
14Northern Illinois University, the Board of Trustees of Western
15Illinois University, the Illinois Community College Board and
16the campuses under their governance or supervision shall not
17hereafter undertake the establishment of any new unit of
18instruction, research or public service without the approval of
19the Board. The term "new unit of instruction, research or
20public service" includes the establishment of a college,
21school, division, institute, department or other unit in any
22field of instruction, research or public service not
23theretofore included in the program of the institution, and

1includes the establishment of any new branch or campus. The
2term does not include reasonable and moderate extensions of
3existing curricula, research, or public service programs which
4have a direct relationship to existing programs; and the Board
5may, under its rule making power, define the character of such
6reasonable and moderate extensions.
7    Such governing boards shall submit to the Board all
8proposals for a new unit of instruction, research, or public
9service. The Board may approve or disapprove the proposal in
10whole or in part or approve modifications thereof whenever in
11its judgment such action is consistent with the objectives of
12an existing or proposed master plan of higher education.
13    The Board of Higher Education is authorized to review
14periodically all existing programs of instruction, research
15and public service at the State state universities and colleges
16and to advise the appropriate board of control if the
17contribution of each program is not educationally and
18economically justified. Each State university shall report
19annually to the Board on programs of instruction, research, or
20public service that have been terminated, dissolved, reduced,
21or consolidated by the university. Each State university shall
22also report to the Board all programs of instruction, research,
23and public service that exhibit a trend of low performance in
24enrollments, degree completions, and high expense per degree.
25The Board shall compile an annual report that shall contain
26information on new programs created, existing programs that

1have been closed or consolidated, and programs that exhibit low
2performance or productivity. The report must be submitted to
3the General Assembly. The Board shall have the authority to
4define relevant terms and timelines by rule with respect to
5this reporting.

8    Sec. 8. The Board of Trustees of the University of
9Illinois, the Board of Trustees of Southern Illinois
10University, the Board of Trustees of Chicago State University,
11the Board of Trustees of Eastern Illinois University, the Board
12of Trustees of Governors State University, the Board of
13Trustees of Illinois State University, the Board of Trustees of
14Northeastern Illinois University, the Board of Trustees of
15Northern Illinois University, the Board of Trustees of Western
16Illinois University, and the Illinois Community College Board
17shall submit to the Board not later than the 15th day of
18November of each year its budget proposals for the operation
19and capital needs of the institutions under its governance or
20supervision for the ensuing fiscal year. Each budget proposal
21shall conform to the procedures developed by the Board in the
22design of an information system for State universities and
23colleges.
24    In order to maintain a cohesive system of higher education,
25the Board and its staff shall communicate on a regular basis

1with all public university presidents. They shall meet at least
2semiannually to achieve economies of scale where possible and
3provide the most innovative and efficient programs and
4services.
5    The Board, in the analysis of formulating the annual budget
6request, shall consider rates of tuition and fees at the state
7universities and colleges. The Board shall also consider the
8current and projected utilization of the total physical plant
9of each campus of a university or college in approving the
10capital budget for any new building or facility.
11    The Board of Higher Education shall submit to the Governor,
12to the General Assembly, and to the appropriate budget agencies
13of the Governor and General Assembly its analysis and
14recommendations on such budget proposals.
15    Each state supported institution within the application of
16this Act must submit its plan for capital improvements of
17non-instructional facilities to the Board for approval before
18final commitments are made if the total cost of the project as
19approved by the institution's board of control is in excess of
20$2 million. Non-instructional uses shall include but not be
21limited to dormitories, union buildings, field houses,
22stadium, other recreational facilities and parking lots. The
23Board shall determine whether or not any project submitted for
24approval is consistent with the master plan for higher
25education and with instructional buildings that are provided
26for therein. If the project is found by a majority of the Board

1not to be consistent, such capital improvement shall not be
2constructed.
