1 | AN ACT concerning education.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The School Code is amended by changing Section | ||||||
5 | 21-28 as follows:
| ||||||
6 | (105 ILCS 5/21-28)
| ||||||
7 | Sec. 21-28. Special education teachers; categorical | ||||||
8 | certification. | ||||||
9 | (a) In order to create a special education workforce with | ||||||
10 | the broad-based knowledge necessary to educate students with a | ||||||
11 | variety of disabilities, the State Board of Education and State | ||||||
12 | Teacher Certification Board shall certify a special education | ||||||
13 | teacher under one of the following: | ||||||
14 | (1) Learning behavior specialist I. | ||||||
15 | (2) Learning behavior specialist II. | ||||||
16 | (3) Teacher of students who are blind or visually | ||||||
17 | impaired. | ||||||
18 | (4) Teacher of students who are deaf or hard of | ||||||
19 | hearing. | ||||||
20 | (5) Speech-language pathologist. | ||||||
21 | (6) Early childhood special education teacher. | ||||||
22 | (b) The State Board of Education is authorized to provide | ||||||
23 | for the assignment of individuals to special education |

1 | positions by short-term, emergency certification. Short-term, | ||||||
2 | emergency certification shall not be renewed. | ||||||
3 | (c) The State Board of Education is authorized to use | ||||||
4 | peremptory rulemaking, in accordance with Section 5-50 of the | ||||||
5 | Illinois Administrative Procedure Act, to place into the | ||||||
6 | Illinois Administrative Code the certification policies and | ||||||
7 | standards related to special education, as authorized under | ||||||
8 | this Section, that the State Board has been required to | ||||||
9 | implement pursuant to federal court orders dated February 27, | ||||||
10 | 2001, August 15, 2001, and September 11, 2002 in the matter of | ||||||
11 | Corey H., et al. v. Board of Education of the City of Chicago, | ||||||
12 | et al. The State Teacher Certification Board shall | ||||||
13 | categorically certify a special
education teacher in one or | ||||||
14 | more of the following specialized categories of
disability if | ||||||
15 | the special education teacher applies and qualifies for such
| ||||||
16 | certification:
| ||||||
17 | (1) Serious emotional disturbance.
| ||||||
18 | (2) Learning disabilities.
| ||||||
19 | (3) Autism.
| ||||||
20 | (4) Mental retardation.
| ||||||
21 | (5) Orthopedic (physical) impairment.
| ||||||
22 | (6) Traumatic brain injury.
| ||||||
23 | (7) Other health impairment.

25 | Section 99. Effective date. This Act takes effect upon | ||||||
26 | becoming law.
