| 3 | | replacing lines 5 through 11, with the following:

| 4 | | "alcohol is prohibited. A licensed fraternal establishment or |
| 5 | | licensed veterans establishment
that does not hold a liquor |
| 6 | | license may operate video gaming terminals
if (i) the |
| 7 | | establishment is located in a municipality within a county with |
| 8 | | a population
between 8,500 and 9,000 based on the 2000 U.S. |
| 9 | | Census and (ii) the
municipality or county prohibits or limits |
| 10 | | the sale of alcohol by ordinance in a way
that prohibits the |
| 11 | | establishment from selling alcohol.".
