1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Emergency Telephone System Act is amended by
5changing Section 15.4 and by adding Sections 2.27 and 2.28 as
6follows:
 
7    (50 ILCS 750/2.27 new)
8    Sec. 2.27. Computer aided dispatch. "Computer aided
9dispatch" or "CAD" means a database maintained by the public
10safety agency or public safety answering point used in
11conjunction with 9-1-1 caller data.
 
12    (50 ILCS 750/2.28 new)
13    Sec. 2.28. Hosted supplemental 9-1-1 service.
14    "Hosted supplemental 9-1-1 service" means a database
15service that electronically provides information to 9-1-1 call
16takers when a call is placed to 9-1-1. The database service
17shall allow telephone subscribers to provide information to
189-1-1 to be used in emergency scenarios. The database service:
19        (1) shall collect a variety of formatted data relevant
20    to 9-1-1 and first responder needs. This information may
21    include, but is not limited to, photographs of the
22    telephone subscribers, physical descriptions, medical

1    information, household data, and emergency contacts.
2        (2) shall allow for information to be entered by
3    telephone subscribers via a secure website where they can
4    elect to provide as little or as much information as they
5    choose.
6        (3) shall automatically display data provided by
7    telephone subscribers to 9-1-1 call takers for all types of
8    phones when a call is placed to 9-1-1 from a registered and
9    confirmed phone number.
10        (4) shall support the delivery of telephone subscriber
11    information via a secure internet connection to all
12    emergency telephone system boards.
13        (5) shall work across all 9-1-1 call taking equipment
14    and allow for the easy transfer of information into a
15    computer aided dispatch system.
16        (6) may be used to collect information pursuant to an
17    Illinois Premise Alert Program as defined in the Illinois
18    Premise Alert Program (PAP) Act.

20    Sec. 15.4. Emergency Telephone System Board; powers.
21    (a) The corporate authorities of any county or municipality
22that imposes a surcharge under Section 15.3 shall establish an
23Emergency Telephone System Board. The corporate authorities
24shall provide for the manner of appointment and the number of
25members of the Board, provided that the board shall consist of

1not fewer than 5 members, one of whom must be a public member
2who is a resident of the local exchange service territory
3included in the 9-1-1 coverage area, one of whom (in counties
4with a population less than 100,000) must be a member of the
5county board, and at least 3 of whom shall be representative of
6the 9-1-1 public safety agencies, including but not limited to
7police departments, fire departments, emergency medical
8services providers, and emergency services and disaster
9agencies, and appointed on the basis of their ability or
10experience. In counties with a population of more than 100,000
11but less than 2,000,000, a member of the county board may serve
12on the Emergency Telephone System Board. Elected officials,
13including members of a county board, are also eligible to serve
14on the board. Members of the board shall serve without
15compensation but shall be reimbursed for their actual and
16necessary expenses. Any 2 or more municipalities, counties, or
17combination thereof, that impose a surcharge under Section 15.3
18may, instead of establishing individual boards, establish by
19intergovernmental agreement a Joint Emergency Telephone System
20Board pursuant to this Section. The manner of appointment of
21such a joint board shall be prescribed in the agreement.
22    (b) The powers and duties of the board shall be defined by
23ordinance of the municipality or county, or by
24intergovernmental agreement in the case of a joint board. The
25powers and duties shall include, but need not be limited to the
26following:

1        (1) Planning a 9-1-1 system.
2        (2) Coordinating and supervising the implementation,
3    upgrading, or maintenance of the system, including the
4    establishment of equipment specifications and coding
5    systems.
6        (3) Receiving moneys from the surcharge imposed under
7    Section 15.3, and from any other source, for deposit into
8    the Emergency Telephone System Fund.
9        (4) Authorizing all disbursements from the fund.
10        (5) Hiring any staff necessary for the implementation
11    or upgrade of the system.
12        (6) Participating in a Regional Pilot Project to
13    implement next generation 9-1-1, as defined in this Act,
14    subject to the conditions set forth in this Act.
15    (c) All moneys received by a board pursuant to a surcharge
16imposed under Section 15.3 shall be deposited into a separate
17interest-bearing Emergency Telephone System Fund account. The
18treasurer of the municipality or county that has established
19the board or, in the case of a joint board, any municipal or
20county treasurer designated in the intergovernmental
21agreement, shall be custodian of the fund. All interest
22accruing on the fund shall remain in the fund. No expenditures
23may be made from such fund except upon the direction of the
24board by resolution passed by a majority of all members of the
25board. Expenditures may be made only to pay for the costs
26associated with the following:

1        (1) The design of the Emergency Telephone System.
2        (2) The coding of an initial Master Street Address
3    Guide data base, and update and maintenance thereof.
4        (3) The repayment of any moneys advanced for the
5    implementation of the system.
6        (4) The charges for Automatic Number Identification
7    and Automatic Location Identification equipment, a
8    computer aided dispatch system that records, maintains,
9    and integrates information, mobile data transmitters
10    equipped with automatic vehicle locators, and maintenance,
11    replacement and update thereof to increase operational
12    efficiency and improve the provision of emergency
13    services.
14        (5) The non-recurring charges related to installation
15    of the Emergency Telephone System and the ongoing network
16    charges.
17        (6) The acquisition and installation, or the
18    reimbursement of costs therefor to other governmental
19    bodies that have incurred those costs, of road or street
20    signs that are essential to the implementation of the
21    emergency telephone system and that are not duplicative of
22    signs that are the responsibility of the jurisdiction
23    charged with maintaining road and street signs.
24        (7) Other products and services necessary for the
25    implementation, upgrade, and maintenance of the system and
26    any other purpose related to the operation of the system,

1    including costs attributable directly to the construction,
2    leasing, or maintenance of any buildings or facilities or
3    costs of personnel attributable directly to the operation
4    of the system. Costs attributable directly to the operation
5    of an emergency telephone system do not include the costs
6    of public safety agency personnel who are and equipment
7    that is dispatched in response to an emergency call.
8        (7.5) The purchase of real property if the purchase is
9    made before March 16, 2006.
10        (8) In the case of a municipality that imposes a
11    surcharge under subsection (h) of Section 15.3, moneys may
12    also be used for any anti-terrorism or emergency
13    preparedness measures, including, but not limited to,
14    preparedness planning, providing local matching funds for
15    federal or State grants, personnel training, and
16    specialized equipment, including surveillance cameras as
17    needed to deal with natural and terrorist-inspired
18    emergency situations or events.
19        (9) The defraying of expenses incurred in
20    participation in a Regional Pilot Project to implement next
21    generation 9-1-1, subject to the conditions set forth in
22    this Act.
23        (10) The implementation of a computer aided dispatch
24    system or hosted supplemental 9-1-1 services.
25    Moneys in the fund may also be transferred to a
26participating fire protection district to reimburse volunteer

1firefighters who man remote telephone switching facilities
2when dedicated 9-1-1 lines are down.
3    (d) The board shall complete the data base before
4implementation of the 9-1-1 system. The error ratio of the data
5base shall not at any time exceed 1% of the total data base.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
