1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Disabled Persons Rehabilitation Act is
5amended by changing Section 10a as follows:
 
6    (20 ILCS 2405/10a)
7    Sec. 10a. Financial Participation of Students Attending
8the Illinois School for the Deaf and the Illinois School for
9the Visually Impaired.
10    (a) General. The Illinois School for the Deaf and the
11Illinois School for the Visually Impaired are required to
12provide eligible students with disabilities with a free and
13appropriate public education as required by Article 14 of the
14Illinois School Code. As part of the admission process to
15either school, the Department shall complete a financial
16analysis on each student attending the Illinois School for the
17Deaf or the Illinois School for the Visually Impaired and shall
18ask parents or guardians to participate, if applicable, in the
19cost of identified services or activities that are not
20education related.
21    (b) Financial Participation. The Department shall
22promulgate rules concerning fees for activities or services at
23the schools with input from (i) the superintendent of each

1school and (ii) Directors of Special Education from selected
2Local Education Agencies who place students at the schools.
3Parents or guardians of students attending the Illinois School
4for the Deaf or the Illinois School for the Visually Impaired
5may be asked to financially participate in the following fees
6for services or activities provided at the schools:
7        (1) Registration.
8        (2) Books, labs, and supplies (fees may vary depending
9    on the classes in which a student participates).
10        (3) Athletic or extracurricular activities (students
11    participating in multiple activities will not be required
12    to pay for more than 2 activities).
13        (4) Driver's education (if applicable).
14        (5) Graduation.
15        (6) Yearbook (optional).
16        (7) Activities (trips or leisure activities not
17    associated with classroom curriculum).
18        (8) Other activities or services identified by the
19    Department, pursuant to rule.
20    Exceptions may be granted to parents or guardians who are
21unable to meet the financial participation obligations. The
22Department shall promulgate rules concerning requests for
23exception to the financial participation at the schools.
24    Any fees collected for activities or services identified in
25(1) through (8) under this subsection (b) shall be held locally
26by the school and used exclusively for the purpose for which

1the fee was assessed. A separate locally held fund shall be
2established by the Illinois School for the Deaf and the
3Illinois School for the Visually Impaired for this purpose.
4Completion of financial analysis. Prior to admission, and
5annually thereafter, a financial analysis shall be completed on
6each student attending the Illinois School for the Deaf or the
7Illinois School for the Visually Impaired. If at any time there
8is reason to believe there is a change in the student's
9financial situation that will affect their financial
10participation, a new financial analysis shall be completed.
11        (1) In completing the student's financial analysis,
12    the income of the student's family shall be used. Proof of
13    income must be provided and retained for each parent or
14    guardian.
15        (2) Any funds that have been established on behalf of
16    the student for completion of their primary or secondary
17    education shall be considered when completing the
18    financial analysis.
19        (3) Falsification of information used to complete the
20    financial analysis may result in the Department taking
21    action to recoup monies previously expended by the
22    Department in providing services to the student.
23    (c) (Blank). Financial Participation. Utilizing a sliding
24scale based on income standards developed by rule by the
25Department with input from the superintendent of each school,
26parents or guardians of students attending the Illinois School

1for the Deaf or the Illinois School for the Visually Impaired
2may be asked to financially participate in the following fees
3for services or activities provided at the schools:
4        (1) Registration.
5        (2) Books, labs, and supplies (fees may vary depending
6    on the classes in which a student participates).
7        (3) Room and board for residential students.
8        (4) Meals for day students.
9        (5) Athletic or extracurricular activities (students
10    participating in multiple activities will not be required
11    to pay for more than 2 activities).
12        (6) Driver's education (if applicable).
13        (7) Graduation.
14        (8) Yearbook (optional).
15        (9) Activities (field trips or other leisure
16    activities).
17        (10) Other activities or services identified by the
18    Department.
19    Students, parents, or guardians who are receiving Medicaid
20or Temporary Assistance for Needy Families (TANF) shall not be
21required to financially participate in the fees established in
22this subsection (c).
23    Exceptions may be granted to parents or guardians who are
24unable to meet the financial participation obligations due to
25extenuating circumstances. Requests for exceptions must be
26made in writing and must be submitted to the superintendent for

1initial recommendation with a final determination by the
2Director of the Division of Rehabilitation Services.
3    Any fees collected under this subsection (c) shall be held
4locally by the school and used exclusively for the purpose for
5which the fee was assessed.
