AMENDMENT TO SENATE BILL 171

2    AMENDMENT NO. ______. Amend Senate Bill 171 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Township Code is amended by adding the
5heading of Article 27 and Sections 27-5 and 27-10 as follows:

ARTICLE 27. DISCONTINUANCE OF THE OFFICE OF TOWNSHIP ASSESSOR

 
8    (60 ILCS 1/27-5 new)
9    Sec. 27-5. Referendum to discontinue the office of Township
10Assessor. By petition of at least 10% of the registered voters
11of a township, as determined on the date registration closed
12before the regular election next preceding the last day on
13which the petition may be filed, of a county that has adopted
14township organization, or upon ordinance or resolution adopted
15by the township board, the township board shall certify and

1cause to be submitted to the voters of the township, at the
2next election, the question of the continuance of the office of
3Township Assessor. A signature on a petition shall not be valid
4or counted in considering the petition unless the form
5requirements are complied with and the date of each signature
6is less than 90 days before the last day for filing the
7petition. The statement of the person who circulates the
8petition must include an attestation (i) indicating the dates
9on which that sheet was circulated, (ii) indicating the first
10and last date on which that sheet was circulated, or (iii)
11certifying that none of the signatures on the sheet was signed
12more than 90 days before the last day for filing the petition.
13The petition shall be treated and the proposition certified in
14the manner provided by the general election law.
15    The proposition shall be in substantially the following
16form:
17        Shall the office of Township Assessor be continued in
18    (name of township)?
19    The votes shall be recorded as "Yes" or "No".

21    Sec. 27-10. Cessation of offices in a township. If a
22majority of the votes of the township cast on the question of
23the continuance of the office of Township Assessor at the
24election are against the proposed option for continuance, then
25the office of Township Assessor shall cease in the township at

1the end of the current term of office. If the office of
2Township Assessor ceases, then (i) the county supervisor of
3assessments or county assessor, as applicable, shall assume the
4duties of the Township Assessor under the Property Tax Code,
5(ii) the county board members shall be the board of health for
6the public health district under the Public Health District
7Act, and (iii) the Office of the Township Collector shall also
8cease.
 
9    Section 10. The Property Tax Code is amended by adding
10Section 3-70 as follows:
 
11    (35 ILCS 200/3-70 new)
12    Sec. 3-70. Cessation of Township Assessor. If the office of
13Township Assessor ceases as provided in Article 27 of the
14Township Code, then the Supervisor of Assessments or County
15Assessor, as applicable, shall assume the duties of the
16Township Assessor under this Code.
 
17    Section 15. The Public Health District Act is amended by
18adding Section 25 as follows:
 
19    (70 ILCS 905/25 new)
20    Sec. 25. Cessation of Township Assessor. If the office of
21Township Assessor ceases as provided in Article 27 of the
22Township Code, then the county board members shall be the board

1of health for the public health district under this Act.
 
2    Section 99. Effective date. This Act takes effect upon
3becoming law.".
