2 | | AMENDMENT NO. ______. Amend Senate Bill 171 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Township Code is amended by adding the |
5 | | heading of Article 27 and Sections 27-5, 27-10, and 27-15 as |
6 | | follows: |

8 | | ARTICLE 27. DISCONTINUANCE OF CERTAIN TOWNSHIP OFFICES |
9 | | (60 ILCS 1/27-5 new) |
10 | | Sec. 27-5. Referendum to discontinue township |
11 | | organization. By petition of at least 10% of the registered |
12 | | voters of a township, as determined on the date registration |
13 | | closed before the regular election next preceding the last day |
14 | | on which the petition may be filed, of a county that has |
15 | | adopted township organization, or upon ordinance or resolution |

1 | | adopted by the township board, the township board shall certify |
2 | | and cause to be submitted to the voters of the township, at the |
3 | | next election, the questions of the continuance of the office |
4 | | of Highway Commissioner and the office of Township Assessor. A |
5 | | signature on a petition shall not be valid or counted in |
6 | | considering the petition unless the form requirements are |
7 | | complied with and the date of each signature is less than 90 |
8 | | days before the last day for filing the petition. The statement |
9 | | of the person who circulates the petition must include an |
10 | | attestation (i) indicating the dates on which that sheet was |
11 | | circulated, (ii) indicating the first and last date on which |
12 | | that sheet was circulated, or (iii) certifying that none of the |
13 | | signatures on the sheet was signed more than 90 days before the |
14 | | last day for filing the petition. The petition shall be treated |
15 | | and the propositions certified in the manner provided by the |
16 | | general election law. |
17 | | The propositions shall be in substantially the following |
18 | | form: |
19 | | Shall the office of Highway Commissioner be continued |
20 | | in (name of township)? |
21 | | Shall the office of Township Assessor be continued in |
22 | | (name of township)? |
23 | | The votes shall be recorded as "Yes" or "No". |

25 | | Sec. 27-10. Cessation of offices in a township. If a |

1 | | majority of the votes of the township cast on the question of |
2 | | the continuance of the office of Highway Commissioner or the |
3 | | office of Township Assessor at the election are against either |
4 | | of the proposed options for continuance, then the office of |
5 | | Highway Commissioner, the office of Township Assessor, or both, |
6 | | as applicable, shall cease in the township at the end of the |
7 | | current term of office. If the office of the Highway |
8 | | Commissioner ceases, then the county superintendent of |
9 | | highways or the county engineer, as applicable, shall assume |
10 | | the duties of Highway Commissioner under the Illinois Highway |
11 | | Code. If the office of Township Assessor ceases, then (i) the |
12 | | county supervisor of assessments or county assessor, as |
13 | | applicable, shall assume the duties of the Township Assessor |
14 | | under the Property Tax Code, (ii) the county board members |
15 | | shall be the board of health for the public health district |
16 | | under the Public Health District Act, and (iii) the Office of |
17 | | the Township Collector shall also cease. |

19 | | Sec. 27-15. Township assets. If the office of Highway |
20 | | Commissioner is discontinued, then the assets of that office |
21 | | shall be appraised and distributed equally between the county |
22 | | and the township.

23 | | Section 10. The Property Tax Code is amended by adding |
24 | | Section 3-70 as follows: |

2 | | Sec. 3-70. Cessation of Township Assessor. If the office of |
3 | | Township Assessor ceases as provided in Article 27 of the |
4 | | Township Code, then the Supervisor of Assessments or County |
5 | | Assessor, as applicable, shall assume the duties of the |
6 | | Township Assessor under this Code. |
7 | | Section 15. The Public Health District Act is amended by |
8 | | adding Section 25 as follows: |
9 | | (70 ILCS 905/25 new) |
10 | | Sec. 25. Cessation of Township Assessor. If the office of |
11 | | Township Assessor ceases as provided in Article 27 of the |
12 | | Township Code, then the county board members shall be the board |
13 | | of health for the public health district under this Act. |
14 | | Section 20. The Illinois Highway Code is amended by adding |
15 | | Section 5-205.10 as follows: |

17 | | Sec. 5-205.10. Cessation of township Highway Commissioner. |
18 | | If the office of Highway Commissioner ceases as provided in |
19 | | Article 27 of the Township Code, then the county superintendent |
20 | | of highways or the county engineer, as applicable, shall assume |
21 | | the duties of Highway Commissioner under this Code.
