1 | AN ACT concerning education.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||
4 | Section 5. The Board of Higher Education Act is amended by | ||||||||||||||||||||||||
5 | changing Section 9.16 as follows:
| ||||||||||||||||||||||||
6 | (110 ILCS 205/9.16) (from Ch. 144, par. 189.16)
| ||||||||||||||||||||||||
7 | Sec. 9.16. Underrepresentation of certain groups in higher | ||||||||||||||||||||||||
8 | education.
To require public institutions of higher education | ||||||||||||||||||||||||
9 | to develop and implement
methods and strategies to increase the | ||||||||||||||||||||||||
10 | participation of minorities, women
and handicapped individuals | ||||||||||||||||||||||||
11 | who are traditionally underrepresented in
education programs | ||||||||||||||||||||||||
12 | and activities. For the purpose of this Section,
minorities | ||||||||||||||||||||||||
13 | shall mean persons who are citizens of the United States or
| ||||||||||||||||||||||||
14 | lawful permanent resident aliens of the United States and who | ||||||||||||||||||||||||
15 | are: (a) Black (a
person having origins in any of the black | ||||||||||||||||||||||||
16 | racial groups in Africa);
(b) Hispanic (a person of Spanish or | ||||||||||||||||||||||||
17 | Portuguese culture with origins in
Mexico, South or Central | ||||||||||||||||||||||||
18 | America, or the Caribbean, regardless of race);
(c) Asian | ||||||||||||||||||||||||
19 | American (a person having origins in any of the original people
| ||||||||||||||||||||||||
20 | of the Far East, Southeast Asia, the Indian Subcontinent or the | ||||||||||||||||||||||||
21 | Pacific
Islands); or (d) American Indian or Alaskan Native (a | ||||||||||||||||||||||||
22 | person having
origins in any of the original people of North | ||||||||||||||||||||||||
23 | America).

1 | The Board shall adopt any rules necessary to administer | ||||||
2 | this Section.
The Board shall also do the following:
| ||||||
3 | ( a) require all public institutions of higher education to | ||||||
4 | develop and
submit plans for the implementation of this | ||||||
5 | Section;
| ||||||
6 | ( b) conduct periodic review of public institutions of | ||||||
7 | higher education to
determine compliance with this Section; and | ||||||
8 | if the Board finds that a public
institution of higher | ||||||
9 | education is not in compliance with this Section,
it shall | ||||||
10 | notify the institution of steps to take to attain compliance;
| ||||||
11 | ( c) provide advice and counsel pursuant to this Section;
| ||||||
12 | ( d) conduct studies of the effectiveness of methods and | ||||||
13 | strategies
designed to increase participation of students in | ||||||
14 | education programs and
activities in which minorities, women | ||||||
15 | and handicapped individuals are
traditionally | ||||||
16 | underrepresented, and monitor the success of students in such
| ||||||
17 | education programs and activities;
| ||||||
18 | ( e) encourage minority student recruitment and retention | ||||||
19 | in colleges
and universities. In implementing this paragraph, | ||||||
20 | the Board shall undertake
but need not be limited to the | ||||||
21 | following: the establishment of guidelines
and plans for public | ||||||
22 | institutions of higher education for minority student
| ||||||
23 | recruitment and retention, the review and monitoring of | ||||||
24 | minority student
programs implemented at public institutions | ||||||
25 | of higher education to
determine their compliance with any | ||||||
26 | guidelines and plans so established,
the determination of the |

1 | effectiveness and funding requirements of minority
student | ||||||
2 | programs at public institutions of higher education, the
| ||||||
3 | dissemination of successful programs as models, and the | ||||||
4 | encouragement of
cooperative partnerships between community | ||||||
5 | colleges and local school
attendance centers which are | ||||||
6 | experiencing difficulties in enrolling
minority students in | ||||||
7 | four-year colleges and universities;
| ||||||
8 | (e-5) require all public institutions of higher education | ||||||
9 | to track the status of those students who are the first in | ||||||
10 | their family to attend an institution of higher education; | ||||||
11 | ( f) mandate all public institutions of higher education to | ||||||
12 | submit data
and information essential to determine compliance | ||||||
13 | with this Section. The
Board shall prescribe the format and the | ||||||
14 | date for submission of this data
and any other education equity | ||||||
15 | data; and
| ||||||
16 | ( g) report to the General Assembly and the Governor | ||||||
17 | annually with a
description of the plans submitted by each | ||||||
18 | public institution of higher
education for implementation of | ||||||
19 | this Section, including financial data
relating to the most | ||||||
20 | recent fiscal year expenditures for specific minority
| ||||||
21 | programs, the effectiveness of such
plans and programs and the | ||||||
22 | effectiveness of the methods and strategies developed by the
| ||||||
23 | Board in meeting the purposes of this Section, the degree of | ||||||
24 | compliance
with this Section by each public institution of | ||||||
25 | higher education as
determined by the Board pursuant to its | ||||||
26 | periodic review responsibilities,
and the findings made by the |

1 | Board in conducting its studies and monitoring
student success | ||||||
2 | as required by paragraph d) of this Section. With
respect to | ||||||
3 | each public institution of higher education such report also | ||||||
4 | shall
include, but need not be limited to, information with | ||||||
5 | respect to each
institution's minority program budget | ||||||
6 | allocations; minority student
admission, retention and | ||||||
7 | graduation statistics; number of financial
assistance awards | ||||||
8 | to undergraduate and graduate minority students; and
minority | ||||||
9 | faculty representation ; and the status of those students who | ||||||
10 | are the first in their family to attend an institution of | ||||||
11 | higher education . This paragraph shall not be construed to
| ||||||
12 | prohibit the Board from making, preparing or issuing additional | ||||||
13 | surveys or
studies with respect to minority education in | ||||||
14 | Illinois.
