AMENDMENT TO SENATE BILL 64 




2    AMENDMENT NO. ______. Amend Senate Bill 64, AS AMENDED, by 
3replacing all of subsection (a-7)  of Sec. 17-2 of Section 5 
4with the following:
5    "(a-7) A person commits a false personation when he or she 
6knowingly and falsely represents himself or herself to be:
7        (1) another actual person and does an act in such 
8    assumed character with intent to intimidate, threaten, 
9    injure, defraud, or to obtain a benefit from another; or
10        (2) a representative of an actual person or 
11    organization and does an act in such false capacity with 
12    intent to obtain a benefit or to injure or defraud 
13    another."; and


 
14by inserting after the last line of subsection (d) of Sec. 17-2 
15of Section 5 the following:
16    "(e) A violation of this Section may be accomplished in 
17person or by any means of communication, including but not

1limited to the use of an Internet website or any form of 
2electronic communication."; and
 
3by replacing all of subsection (b-5) of Sec. 32-5 of Section 5 
4with the following:
5    "(b-5) The trier of fact may infer that a person falsely 
6represents himself or herself to be a public officer or a 
7public employee or an official or employee of the federal 
8government if the person:
9        (1) wears or displays without authority any uniform, 
10    badge, insignia, or facsimile thereof by which a public 
11    officer or public employee or official or employee of the 
12    federal government is lawfully distinguished; or
13        (2) falsely expresses by word or action that he or she 
14    is a public officer or public employee or official or 
15    employee of the federal government and is acting with 
16    approval or authority of a public agency or department.".
