SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Ski Slope Safety Act. Provides that every ski area operator shall ensure that skiers and snowboarders are not permitted to enter ski areas without protective helmets and requires all skiers and snowboarders to wear protective helmets while in a ski area. Sets forth penalties for violations of the Act. Provides that the Director of Public Health shall adopt reasonable rules to enforce compliance with the Act. Makes other changes.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Ski
5Slope Safety Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Department" means the Department of Public Health.
8    "Director" means the Director of Public Health.
9    "Ski area" means all ski slopes, ski trails, and passenger
10tramways administered as a single enterprise within this State.
11    "Ski area operator" means a person, firm, or corporation,
12and its agents and employees, having operational and
13administrative responsibility for any ski area, including any
14agency of the State, any political subdivision thereof, and any
15other governmental agency or instrumentality.
16    "Ski slopes and trails" mean those areas designated by the
17ski area operator for skiing.
18    "Skier" means any person wearing a ski or skis in a ski
19area for the purpose of skiing.
20    "Snowboarder" means any person on a snowboard in a ski area
21for the purpose of snowboarding.
 
22    Section 10. Protective helmet wear in ski areas.

1    (a) Every ski area operator shall:
2        (i) ensure that skiers and snowboarders are not
3    permitted to enter the ski area without a protective
4    helmet;
5        (ii) make available to the public, for sale or lease,
6    protective helmets;
7        (iii) post in a location likely to be seen by all
8    skiers and snowboarders signs of such size and color as
9    will enable skiers and snowboarders to have knowledge of
10    their responsibilities under this Act;
11        (iv) make available at reasonable fees instruction and
12    education for skiers and snowboarders relative to the risks
13    inherent to skiing and snowboarding and the duties
14    prescribed under this Act and conspicuously post notice of
15    the times and places of availability of such instruction
16    and education in locations likely to be seen by all skiers
17    and snowboarders; and
18        (v) make available at reasonable fees educational
19    literature regarding injury prevention.
20    (b) All skiers and snowboarders shall wear a protective
21helmet while in a ski area.
 
22    Section 15. Penalties.
23    (a) If the director finds that a ski area operator has
24knowingly violated the provisions of this Act, then the
25director shall impose a fine of $100 for the first such

1violation and $200 for a second or subsequent violation.
2    (b) The Director shall adopt reasonable rules to enforce
3compliance with this Act.
