AMENDMENT TO SENATE BILL 1

2    AMENDMENT NO. ______. Amend Senate Bill 1 as follows:
 
3on page 3, immediately below line 21, by inserting the
4following:
5    "For the purposes of this subsection (b), a meeting of the
6Senate does not include a perfunctory session day as designated
7by the Senate under its rules."; and
 
8on page 3, line 22, by replacing "appointed" with "designated";
9and
 
10on page 4, line 6, immediately after the period, by inserting
11the following:
12"No person who has been designated by the Governor to serve as
13an acting appointee to any office to which appointment requires
14the advice and consent of the Senate shall, except at the
15Senate's request, be designated again as an acting appointee

1for that office at the same session of that Senate, subject to
2the provisions of this Section."; and
 
3on page 4, lines 7, 19, and 22, by replacing "appointed" each
4time it appears with "designated"; and
 
5on page 4, line 17, immediately after the period, by inserting
6the following:
7"No person who has been designated by the Governor to serve as
8an acting appointee to any office to which appointment requires
9the advice and consent of the Senate shall, except at the
10Senate's request, be designated again as an acting appointee
11for that office at the same session of that Senate, subject to
12the provisions of this Section.
13    During the term of a General Assembly, the Governor may not
14designate a person to serve as an acting appointee to any
15office to which appointment requires the advice and consent of
16the Senate if that person's nomination to serve as the
17appointee for the same office was rejected by the Senate of the
18same General Assembly."; and
 
19on page 5, immediately below line 2, by inserting the
20following:
 
21    "Section 10. The Civil Administrative Code of Illinois is
22amended by changing Section 5-605 as follows:

1    (20 ILCS 5/5-605)  (was 20 ILCS 5/12)
2    Sec. 5-605. Appointment of officers. Each officer whose
3office is created by the Civil Administrative Code of Illinois
4or by any amendment to the Code shall be appointed by the
5Governor, by and with the advice and consent of the Senate. In
6case of vacancies in those offices during the recess of the
7Senate, the Governor shall make a temporary appointment until
8the next meeting of the Senate, when the Governor shall
9nominate some person to fill the office, and any person so
10nominated who is confirmed by the Senate shall hold office
11during the remainder of the term and until his or her successor
12is appointed and qualified. If the Senate is not in session at
13the time the Code or any amendments to the Code take effect,
14the Governor shall make a temporary appointment as in the case
15of a vacancy.
16    During the absence or inability to act of the director of
17any department, or of the Secretary of Human Services or the
18Secretary of Transportation, or in case of a vacancy in any
19such office until a successor is appointed and qualified, the
20Governor may designate some person as acting director or acting
21secretary to execute the powers and discharge the duties vested
22by law in that director or secretary.
23    During the term of a General Assembly, the Governor may not
24designate a person to serve as an acting director or secretary
25under this Section if that person's nomination to serve as the

1director or secretary of that same Department was rejected by
2the Senate of the same General Assembly. This Section is
3subject to the provisions of subsection (c) of Section 3A-40 of
4the Illinois Governmental Ethics Act.
