1 | HOUSE JOINT RESOLUTION

2 | BE IT RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE | ||||||
3 | NINETY-SEVENTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE | ||||||
4 | SENATE CONCURRING HEREIN, that we, the legislature of the State | ||||||
5 | of Illinois, hereby make application to the Congress, under the | ||||||
6 | provisions of Article V of the Constitution of the United | ||||||
7 | States, for the calling of a convention for proposing | ||||||
8 | amendments; and be it further
| ||||||
9 | RESOLVED, That this application is for a convention limited | ||||||
10 | to considering and proposing amendments on the following | ||||||
11 | subjects: | ||||||
12 | (1) improving the fiscal management of the federal | ||||||
13 | government by imposing requirements, with any stated | ||||||
14 | exceptions, that federal expenditures during a fixed time | ||||||
15 | period not exceed federal revenues or anticipated revenues | ||||||
16 | during that time period; imposing prohibitions and/or | ||||||
17 | limits on federal debt; and/or imposing limits on | ||||||
18 | expenditures, revenue, and/or taxes; | ||||||
19 | (2) improving the legislative process by requiring | ||||||
20 | that all bills, orders, votes, and resolutions introduced | ||||||
21 | in and passed by Congress contain only a single subject | ||||||
22 | and/or by providing a minimum time period before passage | ||||||
23 | for bills, orders, votes, and resolutions to be reviewed by | ||||||
24 | members of Congress and members of the general public; |

1 | (3) restraining the powers of the federal government by | ||||||
2 | clarifying that the Constitution does not authorize | ||||||
3 | Congress to employ its spending power to regulate | ||||||
4 | activities otherwise outside its enumerated powers and/or | ||||||
5 | prohibiting mandates or requirements on any state, | ||||||
6 | subdivision of any state, or any official thereof, unless | ||||||
7 | the federal government fully funds the cost of compliance; | ||||||
8 | and | ||||||
9 | (4) empowering the legislatures of the several states, | ||||||
10 | with stated exceptions, to repeal all or certain acts of | ||||||
11 | Congress and/or administrative regulations; and be it | ||||||
12 | further

13 | RESOLVED, That this application shall be deemed an | ||||||
14 | application for a convention to address each and any of the | ||||||
15 | subjects listed in this resolution; for purposes of determining | ||||||
16 | whether two-thirds of the states have applied for a convention | ||||||
17 | addressing any subject, this application is to be aggregated | ||||||
18 | with the applications of any other state legislatures limited | ||||||
19 | to one or more of the subjects listed in this resolution; and | ||||||
20 | be it further | ||||||
21 | RESOLVED, That this resolution constitutes a continuing | ||||||
22 | application and remains in effect until rescission by any | ||||||
23 | sitting session of the legislature of this State; this | ||||||
24 | application does not constitute a recognition that any |

1 | particular activity or activities currently undertaken by the | ||||||
2 | federal government is or are authorized by the Constitution; | ||||||
3 | and be it further | ||||||
4 | RESOLVED, That suitable copies of this resolution be | ||||||
5 | delivered to the President and Secretary of the United States | ||||||
6 | Senate, the Speaker and Clerk of the House of Representatives | ||||||
7 | of the United States Congress, and the Archivist of the United | ||||||
8 | States; to the members of the United States Senate and House of | ||||||
9 | Representatives from this State; and to the presiding officers | ||||||
10 | of each of the legislative chambers in the several States, | ||||||
11 | requesting their cooperation.
