Amends the Department of Public Health Powers and Duties Law of the
Civil Administrative Code of Illinois. Provides that the Department of Public Health shall adopt rules requiring that a breakfast cereal company whose product is the subject of a recall on or after the date 10 years before the effective date of the amendatory Act shall file documentation with the Department asserting that all manufacturing equipment used to produce cereal sold by the company (1) is in compliance with all applicable rules and regulations; and (2) is free from contaminating metals. Provides that the required documentation shall be filed on an annual basis for a period of 5 years. Provides penalties for noncompliance.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Department of Public Health Powers and |
5 | | Duties Law of the
Civil Administrative Code of Illinois is |
6 | | amended by adding Section 2310-665 as follows: |
7 | | (20 ILCS 2310/2310-665 new) |
8 | | Sec. 2310-665. Cereal recall reporting. |
9 | | (a) The Department shall adopt rules requiring that a |
10 | | breakfast cereal company whose product is the subject of a |
11 | | recall on or after the date 10 years before the effective date |
12 | | of this amendatory Act of the 97th General Assembly shall file |
13 | | documentation with the Department asserting that all |
14 | | manufacturing equipment used to produce cereal sold by the |
15 | | company: |
16 | | (1) is in compliance with all applicable rules and |
17 | | regulations; and |
18 | | (2) is free from contaminating metals. |
19 | | (b) The documentation required by this Section shall be |
20 | | filed on an annual basis for a period of 5 years. |
21 | | (c) A company that knowingly fails to comply with the rules |
22 | | adopted under this Section is guilty of a business offense and |
23 | | shall be fined as follows: |
