2 | | All certificates not renewed as provided in this Section or |
3 | | registered in accordance with this Code shall lapse after a |
4 | | period of 6 months from the expiration of the last year of |
5 | | registration. Such certificates may be immediately reinstated |
6 | | upon payment by the applicant to the State Board of Education |
7 | | of (1) any and all back fees, including without limitation |
8 | | registration fees, owed from the time of expiration of the |
9 | | certificate until the date of reinstatement; and (2) a $500 |
10 | | penalty or the demonstration of proficiency by completing 9 |
11 | | semester hours of coursework from a regionally accredited |
12 | | institution of higher education in the content area that most |
13 | | aligns with the educator's endorsement area or areas; provided |
14 | | that, until September 1, 2012, certificates that have lapsed |
15 | | solely for the failure to pay a registration fee may be |
16 | | immediately reinstated upon payment only of any and all back |
17 | | fees, including without limitation registration fees, owed |
18 | | from the time of expiration of the certificate until the date |
19 | | of reinstatement. Any and all back fees and penalty amounts |
20 | | shall be deposited by the State Board of Education into the |
21 | | Teacher Certificate Fee Revolving Fund. Any certificate may be |
22 | | voluntarily surrendered by the certificate holder. A |
23 | | voluntarily surrendered certificate shall be treated as a |
24 | | revoked certificate. |
25 | | (b) When those teaching certificates issued before |
26 | | February 15, 2000 are
renewed for the first time after February |

such
teaching
certificates
shall be exchanged for |
2 | | Standard Teaching Certificates as provided in subsection
(c) of |
3 | | Section 21-2. All Initial and Standard Teaching Certificates, |
4 | | including
those issued to persons who previously held teaching |
5 | | certificates issued before
February 15, 2000, shall be |
6 | | renewable under the conditions
set forth
in this
subsection |
7 | | (b). |
8 | | Initial Teaching Certificates are valid for 4 years of |
9 | | teaching, as provided in subsection (b) of Section 21-2 of this |
10 | | Code, and are renewable every 4 years until the person |
11 | | completes 4 years of teaching. If the holder of an Initial |
12 | | Certificate has completed 4 years of teaching but has not |
13 | | completed the requirements set forth in paragraph (2) of |
14 | | subsection (c) of Section 21-2 of this Code, then the Initial |
15 | | Certificate may be reinstated for one year, during which the |
16 | | requirements must be met. A holder of an Initial Certificate |
17 | | who has not completed 4 years of teaching may continuously |
18 | | register the certificate for additional 4-year periods without |
19 | | penalty. Initial Certificates that are not registered shall |
20 | | lapse consistent with subsection (a) of this Section and may be |
21 | | reinstated only in accordance with subsection (a).
Standard |
22 | | Teaching Certificates are renewable every 5 years as provided
|
23 | | in
subsection (c) of Section 21-2
and subsection (c) of this |
24 | | Section.
For purposes of this Section, "teaching" is defined as |
25 | | employment and
performance of
services in an Illinois public or |
26 | | State-operated elementary school, secondary
school, or
|

1 | | cooperative or joint agreement with a governing body or board |
2 | | of control, in a
certificated teaching position, or a charter |
3 | | school operating in compliance
with the

4 | | (c) In compliance with subsection (c) of Section 21-2 of |
5 | | this Code, which
provides that a
Standard
Teaching Certificate |
6 | | may be renewed by the State Teacher Certification Board
based
|
7 | | upon proof of continuing professional development, the State |
8 | | Board of Education
and
the State Teacher Certification Board |
9 | | shall jointly: |
10 | | (1) establish a procedure for renewing Standard |
11 | | Teaching Certificates,
which shall include but not be |
12 | | limited to annual timelines for the renewal
process and the |
13 | | components set forth in subsections (d) through (k) of this
|
14 | | Section; |
15 | | (2) establish the standards for certificate renewal; |
16 | | (3) approve or disapprove the providers of continuing |
17 | | professional development
activities; |
18 | | (4) determine the maximum credit for each category of |
19 | | continuing
professional development activities, based upon |
20 | | recommendations submitted by
a continuing professional
|
21 | | development
activity task force, which shall consist of 6 |
22 | | staff members from the State
Board of
Education, appointed |
23 | | by the State Superintendent of Education, and 6 teacher
|
24 | | representatives, 3 of whom are selected by the Illinois |
25 | | Education Association
and 3 of
whom are selected by the |
26 | | Illinois Federation of Teachers; |

1 | | (5) designate the type and amount of documentation |
2 | | required to show that
continuing professional development |
3 | | activities have been completed; and |
4 | | (6) provide, on a timely basis to all Illinois |

holders, regional superintendents of |
6 | | schools,
school districts, and others with an interest in |
7 | | continuing professional
development, information about the |
8 | | standards and requirements established
pursuant to this |
9 | | subsection (c). |
10 | | (d) Any Standard Teaching Certificate held by an individual |
11 | | employed and
performing services in an
Illinois public or |
12 | | State-operated elementary school, secondary school, or
|
13 | | cooperative or joint agreement with a governing body or board |
14 | | of control in a
certificated teaching
position or a
charter |
15 | | school in compliance with the Charter Schools Law must be |
16 | | maintained
Valid
and
Active through certificate renewal |
17 | | activities specified in the certificate
renewal procedure
|
18 | | established pursuant to subsection (c) of this Section, |
19 | | provided that
a holder of a Valid
and Active
certificate who is |
20 | | only employed on either a part-time basis or day-to-day
basis |
21 | | as a
substitute
teacher shall pay only the required |
22 | | registration fee to renew his or her
certificate
and maintain |
23 | | it as Valid and Active. All other Standard Teaching |
24 | | Certificates
held may be
maintained as
Valid and Exempt through |
25 | | the registration process provided for in the
certificate |
26 | | renewal
procedure established pursuant to subsection (c) of |

14 | | (e)(1) A Standard Teaching Certificate that has been |
15 | | maintained as Valid
and
Active for the 5 years of the |
16 | | certificate's validity shall be renewed as Valid
and Active
|
17 | | upon the certificate holder: (i)
completing an advanced degree |
18 | | from an approved institution in an
education-related field; |
19 | | (ii)
completing at least
8 semester hours of
coursework as |
20 | | described in
subdivision (B) of paragraph (3) of this |
21 | | subsection (e);
(iii)
(blank); (iv) completing the National |
22 | | Board for
Professional
Teaching Standards process as described |
23 | | in subdivision (D) of
paragraph (3) of
this subsection (e); or |
24 | | (v) earning 120 continuing professional
development
units |
25 | | ("CPDU") as described in subdivision (E) of paragraph (3) of
|
26 | | this

professional development units needed to renew the |
9 | | certificate as Valid and
Active shall
be proportionately |
10 | | reduced by the amount of time the certificate was Valid and
|
11 | | Exempt.
Furthermore, if a certificate holder is employed and |
12 | | performs teaching services
on a
part-time basis for all or a |
13 | | portion of the certificate's 5-year period of
validity, the |
14 | | number
of continuing professional development units needed to |
15 | | renew the certificate as
Valid
and Active shall be reduced by |
16 | | 50% for the amount of time the certificate
holder has
been |
17 | | employed and performed teaching services on a part-time basis. |
18 | | Part-time
shall
be defined as less than 50% of the school day |
19 | | or school term. |
20 | | Notwithstanding any other requirements to the contrary, if |
21 | | a Standard
Teaching
Certificate has been maintained as Valid |
22 | | and Active for the 5 years of the
certificate's validity and |
23 | | the certificate holder has completed his or her
certificate |
24 | | renewal plan before July 1, 2002, the certificate shall
be |
25 | | renewed as Valid and Active. |
26 | | (2) Beginning July 1, 2004, in order to satisfy the |

1 | | requirements for continuing professional development provided |
2 | | for in subsection (c) of Section 21-2 of this Code, each

certificated
teaching position, if the certificate holder |
7 | | is employed and performing
services in an Illinois public

secondary school, or |
9 | | cooperative or joint agreement with a governing body or
board |
10 | | of control, or that certificate or those certificates most |
11 | | closely
related to his or
her teaching position, if the |
12 | | certificate holder is employed in a charter
school. Except as |
13 | | otherwise provided in this subsection (e), the certificate |
14 | | holder's activities must address purposes (A), (B),
(C), or (D) |
15 | | and must reflect purpose (E) of the following continuing |
16 | | professional
development purposes: |
17 | | (A) Advance both the certificate holder's knowledge |
18 | | and skills as a
teacher consistent with the Illinois |
19 | | Professional Teaching Standards and the
Illinois Content |
20 | | Area Standards in the certificate holder's areas of
|
21 | | certification,
endorsement, or teaching assignment in |
22 | | order to keep the certificate holder
current
in those |
23 | | areas. |
24 | | (B) Develop the certificate holder's knowledge and |
25 | | skills in areas
determined
to be critical for all Illinois |
26 | | teachers, as defined by the State Board of
Education, known |

2 | | (C) Address the knowledge, skills, and goals of the |
3 | | certificate holder's
local
school improvement plan, if the |

5 | | elementary school, secondary school, or cooperative or |
6 | | joint
agreement with a governing body or board of control. |
7 | | (D) Expand the certificate holder's knowledge and |
8 | | skills in an
additional teaching field or toward
the
|
9 | | acquisition of another teaching certificate, endorsement, |
10 | | or relevant
education degree. |
11 | | (E) Address the needs of serving students with |
12 | | disabilities, including adapting and modifying the general |
13 | | curriculum related to the Illinois Learning Standards to |
14 | | meet the needs of students with disabilities and serving |
15 | | such students in the least restrictive environment. |
16 | | Teachers who hold certificates endorsed for special |
17 | | education must devote at least 50% of their continuing |
18 | | professional development activities to this purpose. |
19 | | Teachers holding other certificates must devote at least |
20 | | 20% of their activities to this purpose.
|
21 | | A speech-language pathologist or audiologist who is
|
22 | | licensed under the Illinois Speech-Language Pathology and
|
23 | | Audiology Practice Act and who has met the continuing
education |
24 | | requirements of that Act and the rules promulgated
under that |
25 | | Act shall be deemed to have satisfied the continuing
|
26 | | professional development requirements established by the State
|

including
|
25 | | the following: |
26 | | (i) completing non-university credit directly |
|

6 | | Assurance; |
7 | | (iv) training as reviewers of university teacher |
8 | | preparation programs; or |
9 | | (v) participating in or presenting at in-service |
10 | | training programs on suicide prevention or on sexual |
11 | | abuse and assault awareness and prevention . |
12 | | A teacher, however, may not receive credit for conferences, |
13 | | workshops, institutes, seminars, or symposiums that are |
14 | | designed for entertainment, promotional, or commercial |
15 | | purposes or that are solely inspirational or motivational. |
16 | | The State Superintendent of Education and regional |
17 | | superintendents of schools are authorized to review the |
18 | | activities and events provided or to be provided under this |
19 | | subdivision (H) and to investigate complaints regarding |
20 | | those activities and events, and either the State |
21 | | Superintendent of Education or a regional superintendent |
22 | | of schools may recommend that the State Teacher |
23 | | Certification Board and the State Board of Education |
24 | | jointly disapprove those activities and events considered |
25 | | to be inconsistent with this subdivision (H);
|
26 | | (I) other educational experiences related to improving |
|

teacher's
knowledge and skills as a teacher, including |
2 | | the following: |

industry that is systematic, |
7 | | purposeful, and relevant to certificate renewal; |
8 | | (iii) traveling related to one's teaching |
9 | | assignment, directly related to
student achievement or |
10 | | school improvement plans and approved by the regional |
11 | | superintendent of schools or his or her designee at |
12 | | least
30 days prior to the travel experience,
provided |
13 | | that the traveling shall not include time spent |
14 | | commuting to
destinations where the learning |
15 | | experience will occur; |
16 | | (iv) participating in study groups related to |
17 | | student achievement or
school
improvement plans; |
18 | | (v) serving on a statewide education-related |
19 | | committee, including but
not
limited to the State |
20 | | Teacher Certification Board, State Board of Education
|
21 | | strategic agenda teams, or the State Advisory Council |
22 | | on Education of
Children with Disabilities; |
23 | | (vi) participating in work/learn programs or |
24 | | internships; or |
25 | | (vii) developing a portfolio of student and |
26 | | teacher work; |

1 | | (J) professional leadership experiences related to |

the teacher's

3 | | including the following: |

school, school district, |
6 | | regional office of education, State, or national
|
7 | | level; |
8 | | (ii) participating in team or department |
9 | | leadership in a school or
school
district; |
10 | | (iii) participating on external or internal school |
11 | | or school district
review
teams; |
12 | | (iv) publishing educational articles, columns, or |
13 | | books relevant to
the
certificate area being renewed; |
14 | | or |
15 | | (v) participating in non-strike related |
16 | | professional association or
labor organization
service |
17 | | or
activities related to professional development; |
18 | | (K) receipt of a subsequent Illinois certificate or |
19 | | endorsement pursuant to this Article;
|
20 | | (L) completion of requirements for meeting the |
21 | | Illinois criteria for becoming "highly qualified" (for |
22 | | purposes of the No Child Left Behind Act of 2001, Public |
23 | | Law 107-110) in an additional teaching area;
|
24 | | (M) successful completion of 4 semester hours of |
25 | | graduate-level coursework on the assessment of one's own |
26 | | performance in relation to the Illinois Teaching |
|

1 | | Standards, as described in clause (B) of paragraph (2) of |
2 | | subsection (c) of Section 21-2 of this Code; or |
3 | | (N) successful completion of a minimum of 4 semester |
4 | | hours of graduate-level coursework addressing preparation |
5 | | to meet the requirements for certification by the National |
6 | | Board for Professional Teaching Standards, as described in |
7 | | clause (C) of paragraph (2) of subsection (c) of Section |
8 | | 21-2 of this Code.

9 | | (4) A person must complete the requirements of this |
10 | | subsection (e) before the expiration of his or her Standard |
11 | | Teaching Certificate and must submit assurance to the regional |
12 | | superintendent of schools or, if applicable, a local |
13 | | professional development committee authorized by the regional |
14 | | superintendent to submit recommendations to him or her for this |
15 | | purpose. The statement of assurance shall contain a list of the |
16 | | activities completed, the provider offering each activity, the |
17 | | number of credits earned for each activity, and the purposes to |
18 | | which each activity is attributed. The certificate holder shall |
19 | | maintain the evidence of completion of each activity for at |
20 | | least one certificate renewal cycle. The certificate holder |
21 | | shall affirm under penalty of perjury that he or she has |
22 | | completed the activities listed and will maintain the required |
23 | | evidence of completion. The State Board of Education or the |
24 | | regional superintendent of schools for each region shall |
25 | | conduct random audits of assurance statements and supporting |
26 | | documentation. |

3 | | (f) Notwithstanding any other provisions of this Code, a |
4 | | school district is authorized to enter into an agreement with |
5 | | the exclusive bargaining representative, if any, to form a |
6 | | local professional development committee (LPDC). The |
7 | | membership and terms of members of the LPDC may be determined |
8 | | by the agreement. Provisions regarding LPDCs contained in a |
9 | | collective bargaining agreement in existence on the effective |
10 | | date of this amendatory Act of the 93rd General Assembly |
11 | | between a school district and the exclusive bargaining |
12 | | representative shall remain in full force and effect for the |
13 | | term of the agreement, unless terminated by mutual agreement. |
14 | | The LPDC shall make recommendations to the regional |
15 | | superintendent of schools on renewal of teaching certificates. |
16 | | The regional superintendent of schools for each region shall
|
17 | | perform
the following functions: |
18 | | (1)
review recommendations for certificate renewal, if |
19 | | any, received from LPDCs; |
20 | | (2) (blank); |
21 | | (3) (blank); |
22 | | (4) (blank); |
23 | | (5) determine whether certificate holders have met the
|
24 | | requirements for certificate renewal and notify |
25 | | certificate holders
if the decision is not to renew the |
26 | | certificate; |

1 | | (6) provide a certificate holder with the opportunity |
2 | | to appeal a recommendation made by a LPDC, if any, not to |
3 | | renew the certificate to the regional professional |

5 | | (7) issue and forward recommendations for renewal or |
6 | | nonrenewal
of certificate holders' Standard Teaching |
7 | | Certificates to the State Teacher Certification Board; and |
8 | | (8) (blank). |
9 | | (g)(1) Each regional superintendent of schools shall |
10 | | review and concur or
nonconcur
with each recommendation for |
11 | | renewal or nonrenewal of a Standard Teaching
Certificate he or |
12 | | she receives from a local professional development committee, |
13 | | if any,
or, if
a certificate
holder appeals the recommendation |
14 | | to the regional professional development
review committee, the
|
15 | | recommendation for renewal or nonrenewal he or she receives |
16 | | from a regional
professional
development review committee and, |
17 | | within 14 days of receipt of the
recommendation,
shall
provide |
18 | | the State Teacher Certification Board with verification of the
|
19 | | following, if applicable: |
20 | | (A) the certificate holder has satisfactorily |
21 | | completed professional development and continuing |
22 | | education activities set forth in paragraph (3) of |
23 | | subsection (e) of this Section; |
24 | | (B) the certificate holder has submitted the statement |
25 | | of assurance required under paragraph (4) of subsection (e) |
26 | | of this Section, and this statement has been attached to |
|

for |

advising the regional superintendent of schools, |

certificate
holder appeals. This |
10 | | committee shall
consist of at least 4 classroom teachers, one |
11 | | non-administrative
certificated
educational
employee, 2 |
12 | | administrators, and one at-large member who shall be either (i) |
13 | | a
parent, (ii)
a member of the business community, (iii) a |
14 | | community member, or (iv) an
administrator, with preference |
15 | | given to an individual chosen from among those
persons
listed |
16 | | in items (i), (ii), and (iii) in order to secure representation |
17 | | of an
interest not already
represented on the committee. The |
18 | | teacher and non-administrative certificated
educational |
19 | | employee members of the review committee shall be selected by |
20 | | their
exclusive representative, if any, and the administrators |
21 | | and at-large member
shall be
selected by the regional |
22 | | superintendent of schools. A regional superintendent
of |
23 | | schools
may add additional members to the committee, provided |
24 | | that the same proportion
of
teachers to administrators and |
25 | | at-large members on the committee is maintained. Any
additional |
26 | | teacher and non-administrative certificated educational |

6 | | serve on regional professional development review committees
|
7 | | must be known to demonstrate the best practices in teaching or |
8 | | their respective
field of
practice. |
9 | | (h)(1) The State Teacher Certification Board shall review |
10 | | the regional
superintendent of schools' recommendations to |
11 | | renew or nonrenew Standard
Teaching Certificates
and notify |
12 | | certificate holders in writing whether their certificates have
|
13 | | been renewed or
nonrenewed within 90 days of receipt of the |
14 | | recommendations,
unless a certificate holder has appealed a |
15 | | regional
superintendent of schools'
recommendation of |
16 | | nonrenewal, as provided in paragraph (2) of this subsection
|
17 | | (h). The State Teacher Certification Board shall verify that |
18 | | the
certificate holder
has met the renewal criteria set forth |
19 | | in paragraph (1) of subsection (g) of
this Section. |
20 | | (2) Each certificate holder shall have the right to appeal |
21 | | a regional
superintendent of school's recommendation to |
22 | | nonrenew his or her Standard
Teaching Certificate
to
the State |
23 | | Teacher Certification Board, within 14 days of receipt of |
24 | | notice that
the
decision has been sent to the State Teacher |
25 | | Certification Board, which shall
hold an
appeal hearing within |
26 | | 60 days of receipt of the appeal. When such an appeal is
taken,

1 | | the certificate holder's Standard Teaching Certificate shall |
2 | | continue to be
valid until the
appeal is finally determined. |
3 | | The State Teacher Certification Board shall

development review committee's recommendation, if |
6 | | any, and the local
professional
development committee's |
7 | | recommendation, if any, and all relevant documentation to |
8 | | verify
whether the certificate holder has met the renewal |
9 | | criteria set forth in
paragraph (1) of
subsection (g) of this |
10 | | Section. The State Teacher Certification Board may
request that
|
11 | | the certificate holder appear before it. All actions taken by |
12 | | the State
Teacher
Certification Board shall require a quorum |
13 | | and be by a simple majority of those
present and voting.
A |
14 | | record of
all votes
shall be maintained. The State Teacher |
15 | | Certification Board shall notify the
certificate
holder in |
16 | | writing, within 7 days of completing the review, whether his or |
17 | | her
Standard
Teaching Certificate has been renewed or |
18 | | nonrenewed, provided that if the State
Teacher
Certification |
19 | | Board determines to nonrenew a certificate, the written notice
|
20 | | provided to
the certificate holder shall be by certified mail, |
21 | | return receipt requested.
All certificate
renewal or |
22 | | nonrenewal decisions of the State Teacher Certification Board |
23 | | are
final and
subject to administrative review. |
24 | | (i) Holders of Master Teaching Certificates shall meet the |
25 | | same
requirements
and follow the same procedures as holders of |
26 | | Standard Teaching Certificates,
except
that their renewal |

teaching certificate endorsed as a |
5 | | speech-language pathologist who
has been granted the |
6 | | Certificate of Clinical Competence by the
American |
7 | | Speech-Language Hearing Association may renew his or her
|
8 | | Standard Teaching Certificate pursuant to the 10-year renewal |
9 | | cycle set
forth in subsection (d) of Section 21-2 of this Code. |
10 | | (j) Holders of Valid and Exempt Standard and Master |
11 | | Teaching Certificates
who are not employed and performing |
12 | | services in an Illinois public or
State-operated
elementary |
13 | | school, secondary school, or cooperative or joint agreement |
14 | | with a
governing body or board of control, in a certificated |
15 | | teaching position,
may
voluntarily activate their certificates |
16 | | through the regional superintendent of schools of the regional |
17 | | office of
education for the geographic area where their |
18 | | teaching is done. These certificate holders shall follow the |
19 | | same renewal
criteria
and procedures as all other Standard and |
20 | | Master Teaching Certificate holders,
except
that their |
21 | | continuing professional development activities need not
|
22 | | reflect or
address the knowledge, skills, and goals of a local |
23 | | school improvement plan. |

8 | | Section 10. The Critical Health Problems and Comprehensive |
9 | | Health
Education Act is amended by changing Section 3 as |
10 | | follows:

|
12 | | Sec. 3. Comprehensive Health Education Program. The |
13 | | program established
under this Act shall include, but not be |
14 | | limited to, the following major
educational areas as a basis |
15 | | for curricula in all elementary and secondary
schools in this |
16 | | State: human ecology and health, human growth and
development, |
17 | | the emotional, psychological, physiological, hygienic and
|
18 | | social responsibilities of family life, including sexual |
19 | | abstinence until
marriage, prevention and control of disease, |
20 | | including instruction in
grades 6 through 12 on the prevention, |
21 | | transmission and spread of AIDS, age-appropriate sexual abuse |
22 | | and assault awareness and prevention education in grades |
23 | | pre-kindergarten through 12
sexual assault awareness in |
24 | | secondary schools , public and environmental health, consumer |

1 | | health, safety education and
disaster survival, mental health |
2 | | and illness, personal health habits,
alcohol, drug use, and |
3 | | abuse including the medical and legal ramifications
of alcohol, |
4 | | drug, and tobacco use, abuse during pregnancy, sexual
|
5 | | abstinence until marriage, tobacco, nutrition, and dental |
6 | | health. The program shall also provide course material and |
7 | | instruction to advise pupils of the Abandoned Newborn Infant |
8 | | Protection Act.
The program shall include information about |
9 | | cancer, including without limitation types of cancer, signs and |
10 | | symptoms, risk factors, the importance of early prevention and |
11 | | detection, and information on where to go for help. |
12 | | Notwithstanding the above educational areas, the following |
13 | | areas may also
be included as a basis for curricula in all |
14 | | elementary and secondary
schools in this State: basic first aid |
15 | | (including, but not limited to,
cardiopulmonary resuscitation |
16 | | and the Heimlich maneuver), heart disease, diabetes, stroke, |
17 | | the
prevention of child abuse, neglect, and suicide, and teen |
18 | | dating violence in grades 8 through 12. |
19 | | The school board of each
public elementary and secondary |
20 | | school in the State
shall encourage all teachers and other |
21 | | school personnel to acquire,
develop, and maintain the |
22 | | knowledge and skills necessary to properly
administer |
23 | | life-saving techniques, including without limitation the
|
24 | | Heimlich maneuver and rescue breathing.
The training shall be |
25 | | in
accordance with standards of the
American Red Cross, the |
26 | | American Heart Association, or another nationally
recognized |
|

|
1 | | certifying organization.
A school board may use the
services of |
2 | | non-governmental entities whose personnel have expertise in
|
3 | | life-saving techniques to instruct teachers and other school |
4 | | personnel in
these techniques. Each school board
is encouraged |
5 | | to have in
its employ, or on its volunteer staff, at least one |
6 | | person who is certified, by
the American Red Cross or by |
7 | | another qualified certifying agency,
as qualified to |
8 | | administer first aid and
cardiopulmonary resuscitation. In |
9 | | addition, each school board is authorized to
allocate |
10 | | appropriate portions of its institute or inservice days to |
11 | | conduct
training programs for teachers and other school |
12 | | personnel who have expressed an
interest in becoming qualified |
13 | | to administer emergency first aid or
cardiopulmonary |
14 | | resuscitation. School boards are urged to
encourage their |
15 | | teachers and other school personnel who coach school athletic
|
16 | | programs and other extracurricular school activities to |
17 | | acquire, develop, and
maintain the knowledge and skills |
18 | | necessary to properly administer first aid
and cardiopulmonary |
19 | | resuscitation in accordance with standards and requirements
|
20 | | established by the American Red Cross or another qualified |
21 | | certifying agency. Subject to appropriation, the State Board of |
22 | | Education shall establish and administer a matching grant |
23 | | program to pay for half of the cost that a school district |
24 | | incurs in training those teachers and other school personnel |
25 | | who express an interest in becoming qualified to administer |
26 | | cardiopulmonary resuscitation (which training must be in
|

|
1 | | accordance with standards of the
American Red Cross, the |
2 | | American Heart Association, or another nationally
recognized |
3 | | certifying organization) or in learning how to use an automated |
4 | | external defibrillator. A school district that applies for a |
5 | | grant must demonstrate that it has funds to pay half of the |
6 | | cost of the training for which matching grant money is sought. |
7 | | The State Board of Education shall award the grants on a |
8 | | first-come, first-serve basis.
|
9 | | No pupil shall be
required to take or participate in any |
10 | | class or course on AIDS or family
life instruction if his |
11 | | parent or guardian submits written objection
thereto, and |
12 | | refusal to take or participate in the course or program shall
|
13 | | not be reason for suspension or expulsion of the pupil.
|
14 | | Curricula developed under programs established in |
15 | | accordance with this
Act in the major educational area of |
16 | | alcohol and drug use and abuse shall
include classroom |
17 | | instruction in grades 5 through 12. The instruction,
which |
18 | | shall include matters relating to both the physical and legal |
19 | | effects
and ramifications of drug and substance abuse, shall be |
20 | | integrated into
existing curricula; and the State Board of |
21 | | Education shall develop and make
available to all elementary |
22 | | and secondary schools in this State
instructional materials and |
23 | | guidelines which will assist the schools in
incorporating the |
24 | | instruction into their existing curricula. In
addition, school |
25 | | districts may offer, as part of existing curricula during
the |
26 | | school day or as part of an after school program, support |

instruction for pupils or pupils whose parent, |
2 | | parents, or guardians are
chemically dependent.
