Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Medical Assistance Article of the Illinois Public Aid Code. Removes language providing that there shall be a 2-year moratorium on eligibility expansions under the Children's Health Insurance Program, the Covering ALL KIDS Health Insurance program, and the State's medical assistance program and instead provides that the moratorium shall be in effect for either (i) a period of 2 years after January 25, 2011 (the effective date of Public Act 96-1501), or (ii) until the State expands eligibility for legal residents with incomes up to 133% of the federal poverty level as mandated by the provisions of the federal Patient Protection and Affordable Care Act of 2010, whichever is longer. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Children's Health Insurance Program Act is |
5 | | amended by changing Section 26 as follows: |
6 | | (215 ILCS 106/26) |
7 | | Sec. 26. Moratorium on eligibility expansions. Beginning |
8 | | on the effective date of this amendatory Act of the 96th |
9 | | General Assembly, there shall be a 2-year moratorium on the |
10 | | expansion of eligibility through increasing financial |
11 | | eligibility standards, or through increasing income |
12 | | disregards, or through the creation of new programs that would |
13 | | add new categories of eligible individuals under the medical |
14 | | assistance program under the Illinois Public Aid Code in |
15 | | addition to those categories covered on January 1, 2011. This |
16 | | moratorium shall not apply to expansions required as a federal |
17 | | condition of State participation in the medical assistance |
18 | | program.

19 | | This moratorium shall be in effect either (i) for a period |
