Amends the Animal Control Act. Provides that, subject to appropriation, the Department of Agriculture must establish and maintain a dangerous and vicious dog registry. Requires owners of dogs that have been deemed dangerous or vicious to register those animals with their county animal control. Requires county animal control to forward registration information to the Department for posting on the dangerous and vicious dog registry. Requires owners of dangerous and vicious dogs to submit renewal applications each year and to update their registration information when necessary. Establishes registration and renewal fees, which must be deposited into the Dangerous and Vicious Dog Registry Fund for use by the Department to establish the registry. Amends the State Finance Act to create the Dangerous and Vicious Dog Registry Fund. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:
|
4 | | Section 5. The State Finance Act is amended by adding |
5 | | Section 5.811 as follows: |

7 | | Sec. 5.811. The Dangerous and Vicious Dog Registry Fund. |
8 | | Section 10. The Animal Control Act is amended by adding |
9 | | Section 15.5 as follows: |

11 | | Sec. 15.5. Dangerous and vicious dog registry. |
12 | | (a) Subject to appropriation, the Department of |
13 | | Agriculture shall establish and maintain a dangerous and |
14 | | vicious dog registry. |
15 | | (b) Each owner of a dog that has been deemed dangerous or |
16 | | vicious shall be required to register the animal as a dangerous |
17 | | or vicious dog with their county animal control within 14 days |
18 | | after that finding. |
19 | | Each animal control facility in the State shall report each |
20 | | declared dangerous or vicious dog within its jurisdiction to |
21 | | the Department within 30 days after the dog was declared |

2 | | (c) The Department shall receive, post, and maintain the |
3 | | information provided by county animal control on a website. |
4 | | All information collected for the registry shall be |
5 | | available to animal control officials via the website. |
6 | | (d) Registration shall include the name of the animal, a |
7 | | photograph, sex, age, weight, primary breed, secondary breed, |
8 | | color and markings, whether spayed or neutered, the acts that |
9 | | resulted in the dog being designated as dangerous or vicious |
10 | | and associated trial docket information, microchip or tattoo |
11 | | number, address where the animal is maintained, name of the |
12 | | owner, address of the owner, telephone numbers of the owner, |
13 | | and a statement that the owner has complied with the provisions |
14 | | of the dangerous or vicious dog order. |
15 | | The address of the owner along with the name and breed of |
16 | | the dangerous or vicious dog, the acts that resulted in the dog |
17 | | being declared dangerous or vicious, a picture of the dog, and |
18 | | information necessary to access court records of the |
19 | | adjudication shall be available to the general public. |
20 | | (e) By January 31 of each year, until such time as the |
21 | | dangerous or vicious dog is deceased, the owner shall submit a |
22 | | renewal registration to the county animal control where he or |
23 | | she resides that shall include all information contained in the |
24 | | original registration and any updates. |
25 | | In the event that the dangerous or vicious dog is moved to |
26 | | a different location, or contact information for the owner |

1 | | changes in any way or at any time, the owner shall submit a |
2 | | renewal containing the address of the new location or other |
3 | | updated information within 10 days after such a move or change. |
4 | | There shall be no charge for any updated information provided |
5 | | between renewals. |
6 | | The owner shall notify both the Administrator of the county |
7 | | animal control where he or she relocated and the Administrator |
8 | | of the county animal control where he or she formerly resided. |
9 | | Whenever the owner of a dangerous or vicious dog relocates |
10 | | to another state, he or she shall notify (i) the Administrator |
11 | | or other comparable authority in the jurisdiction where he or |
12 | | she relocates and (ii) the Administrator of the county animal |
13 | | control where he or she formerly resided. |
14 | | Each county animal control shall report relocation of each |
15 | | declared dangerous or vicious dog within its jurisdiction |
16 | | within 30 days after the dog is relocated. |
17 | | (f) The owner shall pay a $100 initial registration fee and |
18 | | a $35 annual renewal registration fee to the county animal |
19 | | control in the county where the animal resides. |
20 | | (g) The county animal control shall remit registration fees |
21 | | to the Department of Agriculture on a quarterly basis, to be |
22 | | deposited into the Dangerous and Vicious Dog Registry Fund. |
23 | | (h) The Dangerous and Vicious Dog Registry Fund is hereby |
24 | | created as a special fund in the State Treasury to accept fees |
25 | | from dangerous and vicious dog registrations, appropriations, |
26 | | grants, and donations for the Department of Agriculture to use |
