Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that, a recipient of aid under the State's medical assistance program shall be entitled to coverage for only one emergency room visit per year for a non-emergency situation. Provides that the Department shall not be responsible for providing Medicaid reimbursement for a recipient's non-emergency visits to an emergency room that exceed this one visit per year limitation.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Public Aid Code is amended by |
| 5 | | adding Section 5-4.1a as follows:
|
| 6 | | (305 ILCS 5/5-4.1a new) |
| 7 | | Sec. 5-4.1a. Emergency room use for non-emergency |
| 8 | | situations. Beginning on the effective date of this amendatory |
| 9 | | Act of the 97th General Assembly, a recipient of aid under this |
| 10 | | Article shall be entitled to coverage for only one emergency |
| 11 | | room visit per year for a non-emergency situation. The |
| 12 | | Department shall not be responsible for providing Medicaid |
| 13 | | reimbursement for a recipient's non-emergency visits to an |
