AMENDMENT TO HOUSE BILL 5865




2    AMENDMENT NO. ______. Amend House Bill 5865 as follows:

 
3on page 1, in line 5, by replacing "Section 24-105.1" with 
4"Sections 3-103 and 24-105.1"; and
 
5on page 1, immediately below line 5, by inserting the 
6following:
 



7    "(40 ILCS 5/3-103)  (from Ch. 108 1/2, par. 3-103)



8    Sec. 3-103. Municipality. "Municipality": (1) Any city, 
9village or incorporated town of 5,000
or more but less than 
10500,000 inhabitants,
as determined from the United
States 
11Government statistics or a census taken at any time by the 
12city,
village or incorporated town and (2) any city, village or 
13incorporated
town of
less than 5,000 inhabitants which, by 
14referendum held under Section 3-145
adopts this Article. 
15However, for the period of time after the publication of the

12010 decennial census and prior to the publication  of the 2020 
2decennial census, "municipality" does not include a city, 
3village, or incorporated town: (i) that reached a population of 
45,000 inhabitants as a result of the 2010 decennial census; 
5(ii) that has not established a fund under this Article prior 
6to the effective date of this amendatory Act of the 97th 
7General Assembly; (iii) whose police officers, on that 
8effective date, were participating in the Illinois Municipal 
9Retirement  Fund and were not members of a collective bargaining 
10unit, and (iv) that had a population of 4,800 inhabitants prior 
11to the publication of the 2010 decennial census and a 
12population of less than 5,300 inhabitants after the publication 
13of the 2010 decennial census.
