1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Capital Development Board Act is amended by | |||||||||||||||||||
5 | changing Section 14 as follows:
| |||||||||||||||||||

7 | Sec. 14.
(a) It is the purpose of this Act to provide for | |||||||||||||||||||
8 | the promotion
and preservation of the arts by securing suitable | |||||||||||||||||||
9 | works of art for the
adornment of public buildings constructed | |||||||||||||||||||
10 | or subjected to major renovation by
the State or which utilize | |||||||||||||||||||
11 | State funds, and thereby reflecting our cultural
heritage, with | |||||||||||||||||||
12 | emphasis on the works of Illinois artists.

13 | (b) As used in this Act: "Works of art" shall apply to and | |||||||||||||||||||
14 | include
paintings, prints, sculptures, graphics, mural | |||||||||||||||||||
15 | decorations, stained glass,
statues, bas reliefs, ornaments, | |||||||||||||||||||
16 | fountains, ornamental
gateways, or other creative works which | |||||||||||||||||||
17 | reflect form, beauty and aesthetic
perceptions.

18 | (c) Beginning with the fiscal year ending June 30, 1979, | |||||||||||||||||||
19 | and for each
succeeding fiscal year thereafter, the Capital | |||||||||||||||||||
20 | Development Board shall set
aside 1/2 of 1 percent of the | |||||||||||||||||||
21 | amount authorized and appropriated over $1,000,000 for
| |||||||||||||||||||
22 | construction or reconstruction of each public building | |||||||||||||||||||
23 | projects financed in whole or in
part by State funds and |

1 | generally accessible to and used by the public for
purchase and | ||||||
2 | placement of suitable works of art in such public buildings. | ||||||
3 | The
location and character of the work or works of art to be | ||||||
4 | installed in such
public buildings shall be determined by the | ||||||
5 | Capital Development Board in consultation with the designing | ||||||
6 | architect, provided,
however, that the work or works of art | ||||||
7 | shall be in a permanent and prominent
location.

8 | (d) There is created a Fine Arts Review Committee | ||||||
9 | consisting of the
designing
architect, the Chairman of the | ||||||
10 | Illinois Arts Council or his designee, the
Director of the | ||||||
11 | Illinois State Museum or his designee, the Executive Director | ||||||
12 | of the Capital Development Board or his or her designee, and | ||||||
13 | three persons
from the area in which the project is to be | ||||||
14 | located who are familiar with
the local area and are | ||||||
15 | knowledgeable in matters of art. Of the three local
members, | ||||||
16 | two shall be selected by the County Board to the County in | ||||||
17 | which
the project is located and one shall be selected by the | ||||||
18 | Mayor or other chief
executive officer of the municipality in | ||||||
19 | which the project is located.
The Committee, after such study | ||||||
20 | as it deems necessary, shall recommend three
artists or works | ||||||
21 | of art in order of preference, to the Executive Director of the | ||||||
22 | Capital Development
Board. The Executive Director Board will | ||||||
23 | make the final selection from among the recommendations
| ||||||
24 | submitted to it .
| ||||||
25 | (e) (Blank). There is created a Public Arts Advisory | ||||||
26 | Committee whose function is
to advise the Capital Development |

1 | Board and the Fine Arts Review Committee
on various technical | ||||||
2 | and aesthetic perceptions that may be utilized in the
creation | ||||||
3 | or major renovation of public buildings. The Public Arts | ||||||
4 | Advisory
Committee shall consist of 12 members who shall serve | ||||||
5 | for terms of 2 years
ending on June 30 of odd numbered years, | ||||||
6 | except the first appointees to
the Committee shall serve for a | ||||||
7 | term ending June 30, 1979. The Public Arts
Advisory Committee | ||||||
8 | shall meet four times each fiscal year. Four members
shall be | ||||||
9 | appointed by the Governor; four shall be chosen by the Senate,
| ||||||
10 | two of whom shall be chosen by the President, two by the | ||||||
11 | minority leader;
and four shall be appointed by the House of | ||||||
12 | Representatives, two of whom
shall be chosen by the Speaker and | ||||||
13 | two by the minority leader. There shall
also be a Chairman who | ||||||
14 | shall be chosen from the committee members by the
majority vote | ||||||
15 | of that Committee.

16 | (f) All necessary expenses of the Public Arts Advisory | ||||||
17 | Committee and the
Fine Arts Review Committee shall be paid by | ||||||
18 | the Capital Development Board.
