2 | | AMENDMENT NO. ______. Amend House Bill 5650 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 1. Short title. This Act may be cited as the State |
5 | | Vehicle Use Act. |
6 | | Section 5. Definitions. As used in this Act: |
7 | | "Constitutional officers" means the officers created under |
8 | | Article V of the Illinois Constitution. |
9 | | "Department" means the Department of Central Management |
10 | | Services. |
11 | | "Division of Vehicles" means the Division of Vehicles |
12 | | within the Department of Central Management Services. |
13 | | "State agency" means all departments, officers, |
14 | | commissions, boards, institutions, and bodies politic and |
15 | | corporate of the State. "State agency" does not include the |
16 | | judicial branch, including, without limitation, the several |

1 | | courts of the State, the offices of the clerk of the supreme |
2 | | court and the clerks of the appellate court, and the |
3 | | Administrative Office of the Illinois Courts, the legislature |
4 | | or its committees or commissions, or units of local government. |
5 | | "Vehicle" means any motor vehicle belonging to the State of |
6 | | Illinois or any agency, board, commission, branch, or |
7 | | department thereof or controlled thereby, including |
8 | | automobiles, motorcycles, trucks, and other types of |
9 | | automotive equipment. |
10 | | Section 10. Vehicle use officer; vehicle use policy. |
11 | | (a) Each State agency shall designate a vehicle use officer |
12 | | to monitor the use of State-owned vehicles by that State |
13 | | agency. |
14 | | (b) Each State agency, with the assistance of the vehicle |
15 | | use officer, shall draft a vehicle use policy. All vehicle use |
16 | | policies, other than those drafted by a constitutional officer, |
17 | | shall be submitted to the Division of Vehicles within the |
18 | | Department of Central Management Services and shall be made |
19 | | publicly available on the Department's official Internet |
20 | | website. A vehicle use officer or a constitutional officer |
21 | | shall make the vehicle use policy publicly available on the |
22 | | constitutional officer's official Internet website. A vehicle |
23 | | use policy shall include the following: |
24 | | (1) a policy concerning take-home vehicles, including |
25 | | requirements for emergency use of take-home vehicles and |

1 | | restrictions on the use of take-home vehicles solely for |
2 | | commuting; and |
3 | | (2) procedures regarding daily vehicle use logs and |
4 | | mileage recording. |
5 | | Section 20. Mileage reimbursement. For cases in which a |
6 | | State employee would otherwise use a State-owned vehicle but |
7 | | uses his or her own vehicle instead, a State agency may |
8 | | reimburse a State employee for automobile travel expenses in |
9 | | accordance with the State Travel Regulations and Reimbursement |
10 | | Rates adopted under Section 12-2 of the State Finance Act. |
11 | | Section 25. The Department of Central Management Services |
12 | | Law of the
Civil Administrative Code of Illinois is amended by |
13 | | changing Section 405-280 as follows:

15 | | Sec. 405-280. State garages; passenger cars. |
16 | | (a) To supervise and
administer all State garages used for
|
17 | | the repair, maintenance, or servicing of State-owned motor |
18 | | vehicles
except those operated by any State college or |
19 | | university or by the Illinois
Mathematics and Science Academy; |
20 | | and to acquire, maintain, and administer
the operation of the |
21 | | passenger cars reasonably necessary to the operations
of the |
22 | | executive department of the State government. To this end, the
|
23 | | Department shall adopt regulations setting
forth guidelines |

1 | | for the acquisition, use, maintenance, and replacement of
motor |
2 | | vehicles, including the use of ethanol blended gasoline |
3 | | whenever
feasible, used by the executive department of State |
4 | | government;
shall
occupy the space and take possession of the |
5 | | personnel, facilities,
equipment, tools, and vehicles that are |
6 | | in the possession or
under the
administration of the former |
7 | | Department of Administrative Services for these
purposes on |
8 | | July 13, 1982 (the effective date of Public Act 82-789); and |
9 | | shall,
from time to time, acquire any further, additional, and
|
10 | | replacement
facilities, space, tools, and vehicles that are |
11 | | reasonably
necessary for
the purposes described in this |
12 | | Section. |
13 | | (b) The Department shall evaluate the availability and cost |
14 | | of GPS systems that State agencies may be able to use to track |
15 | | State-owned motor vehicles. |
16 | | (c) The Department shall distribute a spreadsheet or |
17 | | otherwise make data entry available to each State agency to |
18 | | facilitate the collection of data for publishing on the |
19 | | Department's Internet website. Each State agency shall |
20 | | cooperate with the Department in furnishing the data necessary |
21 | | for the implementation of this subsection within the timeframe |
22 | | specified by the Department. Each State agency shall be |
23 | | responsible for the validity and accuracy of the data provided. |
24 | | The Department shall publish the following data as it becomes |
25 | | reasonably available from each State agency on its Internet |
26 | | website annually: |

1 | | (1) vehicle cost data, organized by individual vehicle |
2 | | and by State agency, and including repair, maintenance, |
3 | | fuel, insurance, and other costs, as well as whether |
4 | | required vehicle inspections have been performed; and |
5 | | (2) an annual vehicle breakeven analysis, organized by |
6 | | individual vehicle and by State agency, comparing the |
7 | | number of miles a vehicle has been driven with the total |
8 | | cost of maintaining the vehicle. |
9 | | (d) Beginning on the effective date of this amendatory Act |
10 | | of the 97th General Assembly, and notwithstanding any provision |
11 | | of law to the contrary, the Department may not make any new |
12 | | motor vehicle purchases until the Department sets forth |
13 | | procedures to condition the purchase of new motor vehicles on |
14 | | (i) a determination of need based on a breakeven analysis, and |
15 | | (ii) a determination that no other available means, including |
16 | | car sharing or rental agreements, would be more cost-effective |
17 | | to the State. However, the Department may purchase motor |
18 | | vehicles not meeting or exceeding a breakeven analysis only if |
19 | | there is no alternative available to carry out agency work |
20 | | functions and the purchase is approved by the Manager of the |
21 | | Division of Vehicles upon the receipt of a written explanation |
22 | | from the agency head of the operational needs justifying the |
23 | | purchase.
