Amends the Illinois Municipal Code. Provides that any proposal for the expenditure of municipal funds on a charitable or non-profit organization shall be listed as a separate item on the council's agenda. Sets forth requirements concerning notice. Limits the concurrent exercise of home rule powers. Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 3.1-40-65 as follows: |
6 | | (65 ILCS 5/3.1-40-65 new) |
7 | | Sec. 3.1-40-65. Charitable spending. Any proposal for the |
8 | | expenditure of municipal funds on a charitable or non-profit |
9 | | organization by the municipality shall be listed as a separate |
10 | | item on the city council's agenda. Notice of the meeting where |
11 | | the proposal will be heard shall be published in a newspaper of |
12 | | general circulation within the municipality at least 10 days |
13 | | before the meeting. This Section is a limitation under |
14 | | subsection (i) of Section 6 of Article VII of the Illinois |
15 | | Constitution on the concurrent exercise by home rule |
16 | | municipalities of powers and functions exercised by the State.

17 | | Section 99. Effective date. This Act takes effect upon |
18 | | becoming law.
