Amends the Civil Administrative Code of Illinois. Provides that a department or agency of the State shall not implement any part of the federal health
care reform authorized by the Patient Protection and Affordable Care Act passed by the United States Congress on March 23, 2010 by using an executive order issued by the Governor of Illinois. Sets forth a definition for "federal health
care reform". Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Civil Administrative Code of Illinois is |
5 | | amended by adding Section 5-715 as follows: |
6 | | (20 ILCS 5/5-715 new) |
7 | | Sec. 5-715. Implementation of federal health care reform; |
8 | | prohibition. |
9 | | (a) A department or agency of the State shall not implement |
10 | | any part of the federal health
care reform authorized by the |
11 | | Patient Protection and Affordable Care Act passed by the United |
12 | | States Congress on March 23, 2010 by using an executive order |
13 | | issued by the Governor of Illinois. |
14 | | (b) For the purpose of this Section, "federal health
care |
15 | | reform" means federal legislation or federal regulation that |
16 | | does the following: |
17 | | (1) mandates an individual to purchase health |
18 | | insurance; |
19 | | (2) mandates a small employer to provide health |
20 | | insurance coverage for employees; |
21 | | (3) imposes penalties on small employers who do not |
22 | | provide health insurance for their employees; |
23 | | (4) expands eligibility for the Medicaid program or the |
