SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.811 new
625 ILCS 5/3-699 new

    Amends the State Finance Act and Illinois Vehicle Code to provide for the issuance of Public Safety Diver special license plates. Creates the Public Safety Diver Fund as a special fund in the State treasury. Provides that the applicant shall pay an additional fee of $45 for original issuance of the plates, of which $30 shall be deposited into the Public Safety Diver Fund and $15 shall be deposited into the Secretary of State Special License Plate Fund. Provides that an additional fee of $27 shall be charged for each renewal, of which $25 shall be deposited into the Public Safety Diver Fund and $2 shall be deposited into the Secretary of State Special License Plate Fund. Provides that money in the Public Safety Diver Fund shall be paid to the Illinois Law Enforcement Training and Standards Board for the purposes of providing training, standards, equipment, and facilities to all public safety disciplines involved in public safety diving and water rescue services, with a primary focus toward volunteer responders.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.811 as follows:
 
6    (30 ILCS 105/5.811 new)
7    Sec. 5.811. The Public Safety Diver Fund.
 
8    Section 10. The Illinois Vehicle Code is amended by adding
9Section 3-699 as follows:
 
10    (625 ILCS 5/3-699 new)
11    Sec. 3-699. Public Safety Diver license plates.
12    (a) The Secretary, upon receipt of an application made in
13the form prescribed by the Secretary of State, may issue
14special registration plates designated to be Public Safety
15Diver license plates. The special plates issued under this
16Section shall be affixed only to passenger vehicles of the
17first division, motor vehicles of the second division weighing
18not more than 8,000 pounds, and recreational vehicles as
19defined by Section 1-169 of this Code. Plates issued under this
20Section shall expire according to the multi-year procedure
21established by Section 3-414.1 of this Code.

1    (b) The design and color of the plates shall be wholly
2within the discretion of the Secretary of State. Appropriate
3documentation, as determined by the Secretary, shall accompany
4the application. The Secretary may, in his or her discretion,
5allow the plates to be issued as vanity or personalized plates
6in accordance with Section 3-405.1 of this Code.
7    (c) An applicant shall be charged a $45 fee for original
8issuance in addition to the appropriate registration fee, if
9applicable. Of this fee, $30 shall be deposited into the Public
10Safety Diver Fund and $15 shall be deposited into the Secretary
11of State Special License Plate Fund. For each registration
12renewal period, a $27 fee, in addition to the appropriate
13registration fee, shall be charged. Of this fee, $25 shall be
14deposited into the Public Safety Diver Fund and $2 shall be
15deposited into the Secretary of State Special License Plate
16Fund.
17    (d) The Public Safety Diver Fund is created as a special
18fund in the State treasury. All moneys in the Public Safety
19Diver Fund shall be paid, subject to appropriation by the
20General Assembly and distribution by the Secretary, to the
21Illinois Law Enforcement Training and Standards Board for the
22purposes of providing grants based on need for training,
23standards, and equipment to public safety disciplines within
24the State of Illinois and to units of local government involved
25in public safety diving and water rescue services.
26    (e) The Public Safety Diver Advisory Committee shall

1recommend grant rewards with the intent of achieving reasonably
2equitable distribution of funds between police, firefighting,
3and public safety diving services making application for grants
4under this Section.
5    (f) The administrative costs related to management of
6grants made from the Public Safety Diver Fund shall be paid
7from the Public Safety Diver Fund to the Illinois Law
8Enforcement Training and Standards Board.
