Amends the Illinois Income Tax Act. Provides that the Department of Revenue must print on its standard individual income tax form a provision that allows taxpayers to contribute to the General Revenue Fund. Effective immediately.

1 | | AN ACT concerning revenue.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Income Tax Act is amended by adding |
5 | | Section 507AAA as follows: |
6 | | (35 ILCS 5/507AAA new) |
7 | | Sec. 507AAA. General Revenue Fund donations. For taxable |
8 | | years ending on or after December 31, 2012, the Department must |
9 | | print on its standard individual income tax form a provision |
10 | | (i) indicating that if the taxpayer wishes to contribute to the |
11 | | General Revenue Fund, as authorized by this amendatory Act of |
12 | | the 97th General Assembly, he or she may do so by stating the |
13 | | amount of the contribution (not less than $1) on the return and |
14 | | (ii) stating that the contribution will reduce the taxpayer's |
15 | | refund or increase the amount of payment to accompany the |
16 | | return. Failure to remit any amount of increased payment shall |
17 | | reduce the contribution accordingly. This Section does not |
18 | | apply to any amended return. |
19 | | This provision shall not be considered an income tax |
20 | | checkoff for purposes of Section 509.1 of this Act and shall be |
21 | | included on the standard individual income tax form regardless |
22 | | of the amount of contributions received by the Fund in the |
23 | | previous taxable year.
