     Amends the Fish and Aquatic Life Code. Provides that the Department of Natural Resources shall establish an Asian carp pilot program to permit licensed individuals to shoot Asian carp with a shotgun off of a motorboat in the Illinois River beginning with the 2013 licensing  year. Provides that the individuals must have the appropriate license and use a specific type of ammunition. Provides that the Department may adopt administrative rules to establish and administer the pilot program.

1    AN ACT concerning fish.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Fish and Aquatic Life Code is amended  by 
5changing Section 10-80 and  by adding Section 10-145 as follows:

7    Sec. 10-80. Illegal methods of taking. It shall be unlawful 
8to take any
aquatic life by the use of electricity or any 
9electrical device; a lime,
acid, medical, chemical, or 
10mechanical compound or dope of any medicated
drug; any drug or 
11any fishberry; any dynamite, giant powder, nitro
glycerine, or 
12other explosives; or by means of a snare, treated grain,

13firearms of any kind, except as permitted under Section 10-145 
14of this Act, air gun or gas gun, wire basket, wire seine, wire

15net, wire trotline, or limb lines of any kind.

18    Sec. 10-145. Asian carp pilot program.
19    (a) For the purposes of this Section, "motorboat" shall 
20have the same meaning as in Section 1-2 of the Boat 
21Registration and Safety Act. 
22    (b) The Department shall establish a pilot program for the

1purposes of containing and reducing the invasive aquatic 
2species commonly referred to as Asian carp in the Illinois 
3River beginning with the 2013 licensing year.
4    (c) The Department shall permit the taking of Asian Carp 
5from motorboats with shotguns if the individual or individuals:
6        (1) use ammunition described in 50 C.F.R. 20.21(j); and 
7        (2) are in possession of the proper fishing license.
8    (d) The Department may adopt rules to establish and 
9administer the Asian carp pilot program.
